AGREEMENT <br /> <br /> . <br /> SECTION 1. TLe Project <br /> . The. City and the District agree.that the Pmject will. include the planning, design and <br /> construction and reconstruction of Will Hi Street east of Echo Hollow Road as a City-Standazd <br /> local street. The parties agree that the Project will be completed under the terms and conditions <br /> set forth herein and in the following exlu'bit, which are by this reference, incorporated herein. <br /> EXHIBIT A -Schematic Map with Project description. <br /> SECTION 2. Additional City Work. ~ . <br /> 2.1 ~ The City shall have the right to expand the Project to include additional <br /> improvements to be referred to herein as "Additional City Work." Additional City Work shall <br /> include, but not be limited to: <br /> . 2.1.1 The demolition and reconstruction of Echo Hollow Road as necessary to <br /> create the intersection of the Street with Echo Hollow Road; <br /> 2.1.2 Costs of~the Project that would not be included in an assessment under <br /> Eugene Code Section 7.175(1), such as intersection costs; <br /> 2.1.3 Storm drainage work on Jay Street; and <br /> 2.1.4 , Any other improvements added for public purposes other than for the <br /> purpose of reconstructing the Street to comply with City standards for a local street. <br /> SECTION 3. Additional District'Work. ~ ~ . <br /> 3.1 Subject to agreement by the City, the District may request the Pmject to be <br /> modified to include additional improvements in the right of way requested by the District, such <br /> as driveway intersections, lighting, or other improvements added for District purposes. Such <br /> additional work shall be referred to herein as "Additional District Work." <br /> 3.2 . No design, engineering or construcd~n of Additional District Work will be <br /> commenced except by written and signed change order to this Agreement specifying the work to <br /> be done and under which the District agrees to reimburse 100% of the costs. <br /> SECTION 4. Obligations of District.. The District's obligation under this Agreement shall <br /> include the following.. <br /> 4.1 The District agrees to dedicate for public right-of-way such additional land as the <br /> City deems reasonably required to be included within the right-of-way for the Street. <br /> Intergovernmental Agreement - 2 <br /> <br />
