City of Eugene~Contract~: 2002_00244 ~J~ „ ~ Intergovernmental Agreement For WILL-ffi STREET IlVIPROVRMENTS THIS IlvTERGOYERNMENTAL AGREEMENT (this "Agreement") is made as of ' the 2 day of Apri 1 , 2002 between the Bethel School District ("District's and ~ - the City of Eugene, (`~ugene'~, each party being a unit of local government. RECITALS . 1. The District's property abuts the northern edge of all of that portion of the public -right of way for Will-Hi Street existing east of Echo Hollow Road (the "Street"] within the City . of Eugene, Qregon. 2. .The southern portion of the public right of way for the Street is comprised of a thirty-foot wide strip dedicatai as a public way by Echo Hollow Park and the Echo Hollow Park 1 tt Addition. The northern portion of the public right of way for the Street is a thirty-foot wide strip dedicated as a public way by the bistrict. 3. The Street is currently improved as acounty-standard asphalt mat street with ditches. 4. The District wishes the Street to be improved to comply with City standards for public streets, and is willing to pay for all costs of the Project that would normally be assessed against benefited property if the project were undertaken as a local improvement project under the conditions set forth herein. 5. The~District board of directors passed resolution number 57 on January 14; 2002 . agreeing to pay 100% of the landowner costs associated with the Willhi Street improvements by the City of Eugene. 6. The City has agreed to design, construct and administer the Project, as provided • herein. . 7. The District has requested that the City scheduleconstruction activities with the ~ . . goal of completing the Project prior to the commencement of the 2003 school year. 8. ORS 190.010 authorizes units of government to enter into agreements for the joint performance of anq or all. functions and activities that either party to the agreement has the authority to perform. .
