SECTION XXV COhfPLAIN'I'S <br /> 1. All complaints against any tett~tnt f:or violations of these rules and <br /> regulations shall be made in writing signed by the party submitting <br /> the complaint and shall specify dates, times and witnesses, if any. <br /> SECTION XXVI <br /> 110LD 1IARMI~ESS AGREEh1ENT <br /> 1. The operator agrees to indemnify, defend, and save the City of Eugene, <br /> it's authorized agents, officers, representatives, and employees <br /> harmless from any and all actions, penalties, liability, claims, de- <br /> mands, damages, or loss resulting from claims or court actions, whether <br /> civil, criminal, or in equity, and arising directly or indirectly out <br /> of acts or omissions of the operator, his (its) agents, employees, <br /> servants, guests, or business visitiors. <br /> SECTION XXVII <br /> INSURANCE REQUIREMENTS <br /> 1. To guarantee performance of Section XXVI above, the operator. shall <br /> secure public liability and property damage insurance on which the <br /> City of Eugene shall be named as joint assured with the operator.. <br /> Such policies of insurance shall be maintained in full force and effect <br /> during all terms of existing Leases, agreements, or business licenses <br /> or renewals or extentions thereof. Such policies shall be for not less <br /> than the amount of for each person and <br /> for any one accident, and in addition thereto to carry a minimum of <br /> insurance for property damage liability. If appli- <br /> cable, products liability, and hanger keepers liability insurance in the <br /> <br /> st~zlt amount of will be carried in addition to the above <br /> named insurance. <br /> 2. Copies of all such policies of insurance shall be delivered to the <br /> City of Eugene and shall be held for the benefit of the parties as <br /> their respect iv: interests may appear. The amounts of said insurance <br /> shall not be deamed a limitation on the operators liability to the City <br /> of Eugene, and if, the City of Eugene, or any of its authorized agents, <br /> officers, representative, or employees become liable for any amount in <br /> excess of the insurance, the operator will save and hold them harmless <br /> for the whole thereof. <br /> SECTION XXVIII NON-DISCRIMINATION <br /> a~ 1. The operator shall furnish all services authorized or licensed by the <br /> City o[ Eugene on a fair, equal, and not unjustly discriminatory basis to <br /> all users thereof, regardless of the persons race, color, or national <br /> origin, and shall charge fair, reasonable and not unjustly discriminatory <br /> prices for each unit of service; provided, however, that the operator <br /> may make reasonable and non-discriminatory discounts, rebates, or other <br /> similar types of price reductions to volume purchasers, if permitted by law. <br /> -23 <br /> <br />
