<br /> _ ADMIN(STRATIVE OR<)CR NO. 58-9~-02-F <br /> of the <br /> City Manager of the City of Eugene <br /> ADMINISTRATIVE RULE R-6.451. <br /> ADOPTIN AMENDMENTS TO THE STORMWATER SERVICE METHODOLOGY. <br /> The C ty Manager of the City of Eugene finds that: <br /> A. On November 17, 1993 the City Council adopted Ordinance No. 19939 regarding <br /> wastewater an stornrvater systems and adopting the Stormwater Service Charge Methodology <br /> Paper ("Meth dology"). That Ordinance, and Section 6.451 of the Eugene Code, 1971 as <br /> adopted therei ,provided that the future modifications of the Methodology would be effected by <br /> the City Man aer. <br /> B. Subsequently, on September 2$, 1994, Ordinance No. 19984 was passed by the <br /> City Council nd approved by the Mayor. adopting changes to the monthly stormwater customer <br /> charges, separ ting out components related to roads. <br /> C. As amended by Ordi-Hance No. 19984, the monthly stormwater customer charge <br /> was composed of : (l) a water quality and quantity component; (2) an administrative component; <br /> and (3) a roa component. 1t was intended that reductions and exemptions continue to be <br /> available for ter quality and quantity components for property, but not for the road component. <br /> D. The rate methodology set forth in Exhibit A to Ordinance No. 19984, which <br /> provided for, niplete reductions or exemptions, was amended by an Emergency Rule adopted <br /> by Administra ive Order No. 58-94-27 of the City Manager, effective November 1, 1994 to <br /> clarify that th exemption applied to water quality and quantity components, but not to the road <br /> or administrat ve component. That Emergency Rule will expire on April 30, 1995. . <br /> E. On April 10, 1995 !issued Administrative Order No. 58-95-02 proposing to adopt <br /> as a permanen rule the prior changes to the Methodology effected by Administrative Order No. <br /> 58-94-27, and to further amend the Methodology to incorporate a street related component and <br /> effect minor itorial. changes that would provide for consistent usage of terms throughout the <br /> Methodology, all as more particu~riy set forth in Schedule 1 to Exhibit A to Administrative <br /> Order No. 58 95-02. The proposed revisions implement the action taken by the Council, and <br /> stormwater c stomers will be able to reduce monthly charges for the quantity and quality <br /> components f the charge, but no exemptions will be granted for the street-related and <br /> administrative components of the charge. <br /> F.
