Industrial waste. Waste generated from a source or activity other than related to <br /> a single or multiple dwelling unit. "Industrial waste" includes waste generated by <br /> commercial use of a~residential unit. <br /> Major effort. The responsible person has taken all feasible steps to contain, <br /> mitigate, and clean-up any discharged substance. There must have been active, physical <br /> effort which results in significant improvement of the situation. Verbal communication <br /> is not sufficient by itself, but may be considered as part of the necessary effort. <br /> Minor effort. The responsible person has taken few steps to contain, mitigate, or <br /> clean-up any discharged substance. Due to the lack of active, physical effort, no <br /> significant improvement in the situation is made and/or a significant opportunity to further <br /> contain the discharge or mitigate the situation was missed. Verbal communication is not <br /> sufficient by itself, but may be considered as a part of the necessary effort. <br /> NPDES permit. National Pollution Discharge Elimination System permit issued <br /> pursuant to ORS 468.740 and the Clean Water Act. <br /> Person/Partv. (As in Person Responsible/Responsible Person/Responsible Party.) <br /> Any individual, partnership, joint-venture, firm, company, cooperative, corporation, <br /> association, joint stock company, trust, estate, governmental entity or any other legal <br /> entity. The masculine shall include the feminine and the singular shall include the plural. <br /> Prior enforcement action. Prior citations, civil penalties, or abatement charges <br /> issued by the City against a responsible party for the same type of violation (i.e., <br /> stormwater pollution related). <br /> Prior violation. Similar incidents (i.e., stormwater pollution related), whether or <br /> not enforcement actions were pursued. <br /> Release. Any spilling, leaking, pumping, pouring, emitting, emptying, <br /> discharging, injecting, escaping, leaching, dumping, or disposing of substances to the <br /> environment including the abandoning or discarding of debris, barrels., containers, <br /> underground storage tanks, and other closed receptacles. This excludes: <br /> (a) Any release which results in exposure to a person solely <br /> within a work place, with respect to a claim that the person may assert <br /> against the person's employer under ORS chapter 656; <br /> (b) Emissions from the engine exhaust of a motor vehicle, <br /> rolling stock, aircraft, vessel or pipeline pumping station engine; <br /> (c) Any release of source, by-product or special nuclear material <br /> from a nuclear incident, as these terms are defined in the Atomic Energy <br /> Act of 1954, as amended, if such release is subject to requirements with <br /> respect to financial protection established by the Nuclear Regulatory <br /> <br /> Stormwater System Administrative Rule - 6 <br /> <br />
