Discharges include but are not limited to surface runoff, <br /> dumping, leaching by stormwater, point source connections, and spilling of pollutants. <br /> Enforcement action. Citations, civil penalties, or abatement charges issued, <br /> assessed, or billed against a responsible party. <br /> Enforcement officer. The Director of the City's Public Works Department, <br /> or his or her designee. <br /> Hindered. 'Any action which inhibits the ability of City staff to investigate or <br /> mitigate illegal/improper discharges to the city stormwater system. This includes, but <br /> is not limited to: denying access to a facility to City staff or contract workers <br /> attempting to investigate or contain a discharge; providing false information; <br /> withholding information such as product identification, time of spill, source of <br /> material, or quantity of material discharged. , <br /> Ille ag 1/Improper discharge. Factors which constitute an improper/illegal <br /> discharge include, but are not limited to: <br /> 1. Actions or the lack thereof that create an immediate potential <br /> for pollutants to enter the city stormwater system. If the facility has a <br /> stormwater permit, the pollutant concentration must be above that allowed by <br /> the facility's permit to be considered a violation. <br /> 2. Failure to maintain a private system to prevent pollutants from <br /> entering the city stormwater system. If the facility has a stormwater permit, <br /> the pollutant concentration must be above that allowed by the facility's permit <br /> to be considered a violation. <br /> 3. Discharges from a point source prohibited by either local, state, <br /> or federal law. This includes discharges once allowed by these laws which are <br /> now prohibited. This would include cooling water which has been chemically <br /> altered or has an elevated temperature. If the facility has a stormwater <br /> permit, the pollutant concentration must be above that allowed by the facility's <br /> permit to be considered a violation. <br /> 4. Intentional dumping of waste products into (a) the city <br /> stormwater system; or (b) a private system which, if the private system is not <br /> cleaned or the situation mitigated, creates the potential for pollutants to enter <br /> the city stormwater system. <br /> 5. Pollutants leached by rainwater from stored materials or from <br /> leaking or spilled products which are then carried by surface runoff or other <br /> means to the city stormwater system. <br /> 6. Release of pollutants due to: washing spilled materials into the <br /> city stormwater system or to a private system which, if the private system is <br /> not cleaned or the situation mitigated, creates the potential for pollutants to <br /> enter the city stormwater system; failure to clean-up or mitigate a spill; failure <br /> to store materials under cover; cleaning equipment so as to allow the <br /> <br /> Proposed stormwater System Administrative Rule - 2 01/12/96 , <br /> <br />
