E. There are currently two classifications to the MWMC Equalization Fee. The Residential ~ <br /> Fee is applicable to single family residences and residential uses of up to two dwelling units, with the ` <br /> fee being based on the number of dwelling units in the development. All other uses are classified as <br /> Commercial/Industrial. For newly developing Commercial/Industrial property, the fee is currently <br /> calculated based on the number of plumbing fixture units in the development. The fee for existing <br /> Commercial/Industrial property connecting to the sanitary sewer system for the first time is currently <br /> calculated based on the amount oi: water used by the existing development. <br /> F. A one-time credit for MWMC fees is available for newly connecting property within the <br /> City and for property outside the City. The amount of credit for newly connecting property within the <br /> City is based on the date of annexation to the City, the date of construction of any improvements <br /> since 1978, and the current value of the land and improvements. For development outside the City, <br /> the credit is based on the date of assessment for the sewer, the date of construction of any <br /> improvements, and the current value of land and improvements. <br /> G. MWMC has requested a revision in the MWMC Facilities Equalization Fee and Credits, as <br /> provided in EC 7.075(2), for the fiscal year beginning July 1, 1996, and I find the proposed MWMC <br /> Fees and Credits, as set forth in Exhibit A hereto are established in an amount designed to equal the <br /> amount existing system users have paid for reserve capacity since 1978. <br /> H. I find that the proposed revisions to the City of Eugene SDC Methodology to establish a <br /> large volume wastewater user classification, as set forth in Exhibit A hereto, provides a method of <br /> equating the impact of the large volume wastewater users with the City's dwelling unit based SDC <br /> structure. <br /> 1. I find that the automatic adjustment to the City of Eugene SDC Fees, as set forth in <br /> Exhibit A hereto, should be effective July 1, 1996 pursuant to the 1993 SDC Methodology.. <br /> J. I find that the proposed revisions to the MWMC Equalization Fees and Credits, and the <br /> City of Eugene SDC Methodology and Fees, as set forth in Exhibit A hereto are established in <br /> conformity with applicable state law, adopted City policies, guidelines, and ordinances, inGuding <br /> Sections 2.020 and 7.710 of the Eugene Code, 1971, are comparable and generally below the fees <br /> charged by otherjurisdictions, and I therefore intend to establish the MWMC Facilities Equalization <br /> Fees and Credits, and amend the currently effective City of Eugene SDC Methodology, as set forth in <br /> Exhibit A, to be implemented effective July 1, 1996. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, published in the <br /> Register Guard, a newspaper of general circulation within the City, posted at two locations at City <br /> Hall, and be made available for intere~tecl persons at the offices of the City Engineer, 858 Pear! <br /> Street, Eugene, Oregon 97401 during normal business hours (8:00 a.m. to 5:00 p.m., Monday through <br /> Friday, exclusive of holidays). <br /> 2. All persons desiring to comment thereon shall submit written comments as set forth in the <br /> <br /> Notice.
