I <br /> I <br /> ~ <br /> ADMINISTRATIVE ORDER NO. 58-96-13 <br /> of the <br /> City Manager Pro Tem of the City of Eugene <br /> CONCERNING NOTICE OF PROPOSED ESTABLISHMENT OF FEE FOR <br /> ~ LONGTERM USE OF THE SURFACE OF THE PUBLIC RIGHT-OF-WAY <br /> The City Manager of the City of Eugene finds as follows: <br /> i <br /> A. Pursuant to the provisions of Sections 2.020 and 7.290 to 7.340 of the Eugene <br /> Cade, 1971 which authorize the City Manager to determine and set fees and charges to be <br /> imposed by the City for services, goods, use of municipal property, licenses and permits, and <br /> !specifically including, fees for permits, activities, or uses affecting the public right-of--way, by <br /> Administrative Order No. 58-94-O1-F the City Manager established Right-of--Way Use Permit <br /> Fees as set forth in Exhibit A thereto. <br /> i B. Administrative Order No. 58-94-01-F sets forth the fees applicable for residential <br /> ~ anal commercial temporary use of the right-of--way, but no provision has been made for long-term <br /> I, use of the surface of the public right-of--way, and the schedule of fees attached as Exhibit A <br /> thereto should be amended as hereinafter set forth. <br /> ~ C. Staff has advised that there are occasions when activities necessitate long-term use <br /> of 'the surface of the right-of--way, and that a fee based on the square footage of use per year <br /> <br /> ` ~ should be established, with a one year fee established as the minimum fee to be charged for such <br /> use for a period of one year, or any portion thereof, as set forth in the Notice of Intended Fee <br /> attached as Exhibit A hereto. <br /> D. I find that the proposed fee is consistent with applicable policies and directives of <br /> ~ tho City Council, including policies developed through the Eugene Decisions process, is based on <br /> ~ the City's estimation of the costs associated with processing and monitoring such requests, and <br /> is necessary in order to recover the cost from the beneficiaries thereof. <br /> ' On the basis of these findings, I order that: <br /> I <br /> 1. Copies of the Notice be, provided to the Mayor and City Councilors, posted at two <br /> locations at City Hall, and be mach available for interested persons at the offices of the City <br /> Engineer, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to <br /> 5:40 p.m., Monday through Friday, exclusive of holidays). <br /> i <br /> 2. All persons desiring to comment thereon shall submit written comments as set forth <br /> in Elie Notice.
