<br /> y' <br /> APPENDIX A <br /> ORDINANCE N0. 19773 <br /> N ORDINANCE REGARDING SYSTEMS DEVELOPMENT CHARGES; <br /> ENDING SECTIONS 7.010 AND 7.065 OF THE EUGENE CODE, <br /> 971; ADDING SECTIONS 7.407, 7.700, 7.702, 7.705, <br /> .710, 7.715, 7.720, 7.725, 7.730, 7.735, ANO 7.740 <br /> 0 THAT CODE; REPEALING SUBSECTION 7.175(2)(b)5.d, <br /> ECTIONS 7.245, 7.275, 7.277, 7.279, 7.281, 7.283, <br /> ND SECTION 7.285 OF THAT CODE; ANO DECLARING AN <br /> MERGENCY. <br /> THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> Section 1. The Council hereby finds: <br /> A. Se tion 4 of the Eugene Charter of 1976, ORS 223.208 and 223.297 <br /> through 223.314 grant the City the authority to impose system development <br /> charges (SD ) to equitably spread the cost of essential capital improvements <br /> tQ new deve opment. <br /> 6. Gi en the mobility of the population and the geographic size of the <br /> City, most apital improvement projects benefit new development regardless of <br /> where in th City it occurs. The entire community's health may be affected <br /> if adequate y sized sanitary and storm sewers are not provided in all loco- <br /> t'~ons of th City and its environs. Except as modified in Finding D below, <br /> development is occurring throughout the entire City and no single area of the <br /> City is exp riencing such a high level of new development activity to require <br /> SG~,O revenue from development in one area be dedicated to that same area. It <br /> is~ more cos efficient to use SDC revenue from new development in the entire <br /> co~'mmunity t finance the growth related portion of capital improvements based <br /> upon a city wide priority rather than to hold the.SOC revenue generated in <br /> on,e area of the community for improvements just in that area. <br /> C. Th increase in administrative cost to account for receipt and expen- <br /> di,ture of S D revenues based upon geographic areas of the City rather than on <br /> a city-wide basis would divert revenue from needed capital improvement pro- <br /> jects. Exc pt as stated in Finding D below, the benefit of minimizing admin- <br /> is~trative c sts attributable to the system development charge outweighs the <br /> benefit of llocating SDC revenues and expenditures based upon geographic <br /> areas. <br /> D. In an endeavor to equitably spread the cost of providing sanitary <br /> seyver servi a between new development within the corporate limits of the <br /> Ci y and existing and new development in the unincorporated areas of River <br /> Road and Sa to Clara, the system development charge established for sanitary <br /> sewers in River Road and Santa Clara shall recover the cost of capital im- <br /> prbvements onstructed to serve those areas. To the extent possible the <br /> methodology for sanitary sewers shall take into account the necessity of <br /> segregating such SOC revenue and expenditures.
