<br /> ~ i <br /> ADMINISTRATIVE ORDER NO. 58-97-02-F-1 <br /> ~ of the <br /> ~I, City Manager of the City of Eugene <br /> AME MENT OF REGIONAL WASTEWATER SYSTEMS DEVELOPMENT <br /> CHARGE THODOLOGY. <br /> i <br /> The ~ity Manager of the City of Eugene finds as follows: <br /> A. ~ Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager <br /> of the City f Eugene to determine and set fees and chazges to be imposed by the City for <br /> services, go ds, use of municipal property, and licenses and permits, and specifically systems <br /> development charges. Section 7.710 of the Eugene Code, 1971 further authorizes the City <br /> Manager to opt and/or amend by administrative order, the methodologies used for establishing <br /> the systems development chazges, and provides this may be effected concurrent with the <br /> establishmen or revision of a systems development chazge. ' <br /> B. In accordance with the procedures set forth therein, on January 17, 1997, <br /> l~dministrati a Order No. 58-97-02 was issued by the City Manager Pro Tem, and the Mayor and <br /> Council were notified that the City Manager intended to amend the Systems Development Chazge <br /> Methodolog}~ by: (1) increasing the SDC rate structure to respond to the increased costs of <br /> constructing ublic facilities to serve new development; (2) reformatting the SDC Methodology <br /> document to prove its readability and simplify the update process; (3) revising some practices, <br /> such as el' ting SDC credit for private stormwater detention facilities, increasing the length <br /> of time that p 'vate impact mitigation facilities must remain in operation to qualify for SDC credit, <br /> reducing the eshold when a change of use will result in collection of transportation SDCs, and <br /> placing a ca on the administrative charge that may be collected;. (4) decreasing the percentage <br /> rate used to Calculate the administrative charge from 7.25 % to 5 (5) modifying the annual <br /> inflation adjustment process by broadening the source information used to address annual inflation <br /> adjustments o the rates to include local information in addition to the past exclusive use of the <br /> national cons etion cost index; and (6) modifying the method for calculating regional wastewater <br /> SDCs to incl de a new "large volume user" classification in response to a resolution passed by <br /> tl~e Metropol' Wastewater Commission, all as set forth in the Notice of Intended Amendment <br /> o~ Systems evelopment Charge Methodology attached as Exhibit A thereto and incorporated <br /> therein by re~erence. <br /> { <br /> C, The Notice was published on January 21, 22, 23, 24, and 25, 1997, in the Register <br /> Guard, a ne spaper of general circulation within the City, posted at four public locations on <br /> January 21, 997, and copies of the Proposed Systems Development Chazge Methodologies, <br /> 11+Iarch 1, 19 7, were made available for inspection by interested persons at City Hall, the City <br /> Public Works Building Lobby, 858 Pearl Street, Eugene, Oregon 97401, the Permit and <br /> Information Center Lobby, and the Eugene Public Library during normal business hours (8:00 <br /> Administrative Order - 1 o3ii2i~ <br /> <br />
