<br /> i <br /> i <br /> MetroPlan includes the following goals and policies related to the financing of <br /> newdevelopment: <br /> Generally reduce public subsidy for utilities and facilities in new development <br /> (#5, p. III-G-S). <br /> In general, the amount of public subsidy for public utilities, services and <br /> facilities, including schools in new development, shall be reduced. 1, p. III- <br /> G-5). <br /> 1.2 State Legislation <br /> In 1977 ORS 223.208 was enacted which was the first state-wide legislation on SDCs. <br /> j It empowered cities to impose an SDC but reggired property owners be afforded an <br /> opportunity to pay part of the SDC in installments. Thereafter in 1989 in ORS <br /> 223.297 through 223.314 the State placed additional requirements on cities if they <br /> were to collect SDCs. These requirements have since been amended and the changes <br /> incorporated in the Eugene Code, 1971. <br /> The 1989 legislation (ORS 223.297 - 223.314) created a uniform framework that all <br /> local governments must follow to collect SDC fees. Under EC 7.715 charges can be <br /> used only for specific systems---transportation, sanitary sewers, storm sewers, parks, <br /> and water systems---and must be based on the amount of impact to a particular <br /> system. All revenues must be used to build capital improvements to the system for <br /> which they were collected or to reimburse funds previously used to construct needed <br /> capacity to support new development or to retire qualifying debt. The granting of <br /> credits or exemptions is authorized under state law and EC 7.725 and 7.730. <br /> as orce <br /> To bring the city into compliance with the 1989 state law, a City Council <br /> subcommittee, the Council Committee on Infrastructure (CCI), worked for several <br /> months on a draft ordinance and methodology.
