r ~ 1 ~ ADMINISTRATIVE ORDER NO. 58-97-07-F of the _ City Manager of the City of Eugene ~ AMENDMENT OF MWMC PROVISIONS OF SYSTEMS DEVELOPMENT CHARGE METHODOLOGIES , i ADOPTED BY ADMINISTRATIVE ORDER NO. 58-97-02-F. i The ity Manager of the City of Eugene finds as follows: A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager of the City f Eugene to determine and set fees and charges to be imposed by the City for services, go s, use of municipal property, and licenses and permits, and specifically systems development charges. ,Section 7.710 of the Eugene Code, 1971 further authorizes the City Manager to a opt and/or amend by administrative order, the methodologies used for establishing the systems development charges, and provides this may be effected concurrent with the establishmen or revision of a systems development charge. B. In accordance with the procedures set forth therein, and in response to a resolution passed by Metropolitan Wastewater Commission (MWMC), on May 23, 1997 I issued Administrati a Order No. 58-97-07 and notified the Mayor and City Council that I intended to ~ amend porti of the Systems Development Charge Methodologies relating to MWMC by: (1) redefining th MWMC SDC as a combined reimbursement fee and improvement fee; (2) adding ' ~ and definin flow estimation units E cafe o 3 establishin a rocess for reviewin the g gry;() g P g capital impr vement program and calculating the SDC fees to be charged when a large volume user connec to the system; resulting in revisions to Table 1 on page 3, Figure 1 on page 5, Section 4.2 s " g on page 7, Table 2 on page 15, Appendix B on pages B-1 and B-2, Appendix D on pages -6 through D-10, and Appendix G on pages G-3 through G-5; and (4) revising the title and para aph 1 of the text of Section 2.4 on page 6 by inserting the phrase "City of Eugene" to clarify it r ferences expending City of Eugene SDC's, all as set forth in the Notice of Intended Amendment f MWMC Provisions of Systems Development Charge Methodologies attabhed as Exhibit A th reto and incorporated therein by reference. C. The Notice was published on May 29, June 1 and 4; 1997 in the Register Guard, a newspaper of general circulation within the City, posted at four public locations on May 29, x997, and- ies of the Proposed Revisions to the Systems Development Charge Methodologies were made a ailable for inspection by interested persons at City Hall, 777 Pearl Street, Eugene, Oregon 974 1; the City Public Works Building Lobby, 858 Pearl Street, Eugene, Oregon 97401; the Permit nd Information Center Lobby, Atrium Building, 99 West 10th Avenue, Eugene, Oregon 974 l; and the Eugene Public Library, 100 West 13th Avenue, Eugene, Oregon 97401, during no al business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays, ex pt for the Library). The Notice provided that written comments could be submitted thereon for period of 30 days from the first date of publication and posting. D.
