Damage to City Irrigation Facilities - If a City irrigation line is damaged, the <br /> permittee shall notify the Utility Inspector who will consult with the City parks <br /> maintenance supervisor. The City parks maintenance supervisor shall have the <br /> option of providing repairs consultation to the permittee responsible for the damage, <br /> directing the repair performed by the person(s) responsible for the damage, or <br /> having the repair performed by City crews at the expense of the permittee responsi- <br /> ble for the damage. <br /> Damage to Public Trees - When a street tree or tree on City-controlled property is <br /> damaged, the Utility Inspector must be notified and the City's Urban Forester <br /> consulted. The City may require an assessment of tree damage and future health <br /> by a certified arborist. If a damaged tree must be removed due to the severity of <br /> damage or creation of a hazardous condition, a tree removal permit must be <br /> obtained and the tree removed at the expense of the permiee and subject to the <br /> conditions imposed upon the tree removal permit. Tree removal permit conditions <br /> typically include a requirement to replace the removed tree with a tree of similar <br /> value or to pay the City the value of the tree removed. EC 6.305(3) <br /> Section 4: MAINTENANCE RESPONSIBILITIES <br /> 4.A GENERAL <br /> Patches or excavations within the public way in need of maintenance shall be reported to <br /> the Utility Inspector. In most cases, a utility cut requires maintenance or repair if any part <br /> of the replacement surfacing deviates more than 3/4" from the finished surface street <br /> grade or'/2' from a finished sidewalk grade. <br /> If upon reasonable notice, the permittee fails to restore and maintain the public way <br /> affected by the permittee's work, the City may perform the work and charge the cost to the <br /> permittee. If, in the judgement of the Maintenance Planning Manager, a hazardous or <br /> dangerous condition exists that affects the public health, safety and welfare, the notifica- <br /> tion requirement may be waived and the City may take necessary corrective action to <br /> remove the hazardous conditions and charge the costs thereof to the responsible party <br /> without prior notification. EC 7.308 (3) <br /> If more than one permittee has worked within the affected area, the Maintenance Planning <br /> Manager shall allocate the responsibility and cost for restoration and maintenance. <br /> Factors to be considered in the allocation of responsibility include the nature of the work <br /> each performed, the type of deterioration occurring, when each permittee performed work, <br /> the kind of equipment and construction techniques each used, and other such factors <br /> <br /> which may be deemed relevant.
