f,
i
ii
~f ,
i;
I'
L r'.

7
' Finding: Staff agrees that the term "facility" needs to be defined. The intended
I'~, m g of the term "facility"in the proposed fee schedule is that each facility type, e.g.
electri ,water, or telecommunication facility, under a single provider's ownership and
jl, install d under a single project/permit shall be considered a "facility" for purposes of
calcul ting permit fees. In the example given of two EWEB-owned electric conduits
install in a joint trench, both conduits would be considered a single facility for purposes
of pe it fee assessment so long as both conduits were installed under the same project.
This d finition will be included in the fee table, to clarify the meaning.
E. I find that the proposed increase in excavation permit fees and new right-of--way
coif permit fee for construction within and use of the public way aze consistent with applicable
policies and irectives of the City Council, including policies developed through the Eugene
Decisions r ess are based on the Ci 's estimation of the costs associated with rovidin the
P tY P g
services and a necessa in order to im lement newl revised rovisions of the Eu ene Code
rY P Y P g
1971 and reco er the cost from the beneficiazies of the services. Administrative Order No. 58-96-
13-F should b repealed, and the Right-of=Way Use Permit Fee schedule attached as Exhibit A
hereto adopt as amended herein.
On the basis of these findings, I order that:
1. Administrative Order No. 58-96-13-F is hereby repealed, as of midnight, June 30,
1997.
2. The fees set forth in the Right-of--Way Use Permit Fees schedule set forth in Exhibit
A hereto are h reby established and/or ratified and affirmed as the fees to be charged for the uses
set forth-there , as of 12:01 a.m. on July 1, 1997.
Dated his day of June, 1997.
~
Vicki Elmer
City Manager
I
I''i
Administrativ Order - 2
