CITY OF EUGENE <br /> Department of Public Works <br /> Policies and Procedures <br /> Utility and Right-of--Way Permits <br /> Construction Within and Use of the Public Way <br /> Section 1: GENERAL <br /> The provisions herein shall go into effect December 1, 1997. <br /> 1.A AUTHORITY <br /> This operational policy and procedure document was prepared and enacted under the <br /> administrative and rule-making authority granted the City Manager by Section 2.019 of the <br /> Eugene Code and the authority granted the City Engineer by Section 7.007 of the Eugene <br /> <br /> . Code. <br /> 1.B INTRODUCTION <br /> Street rights-of--way and public utility easements (public way) are intended for the use of <br /> all citizens for vehicular and pedestrian movement, access to private property and the <br /> delivery of essential utility, fire, police and transportation services. Section 7.007 of the <br /> Eugene Code charges the City Engineer with the responsibility of protecting the public's <br /> rights within the public way for these purposes. That responsibility is discharged in part by <br /> controlling construction and special uses of the public way through the issuance of <br /> permits. Section 7.302 of the Eugene Code specifies that the City Manager issue <br /> administrative rules related to construction within and use of the public way. This manual <br /> has been adopted as a part of Administrative Rule R-7.302 under the rule-making <br /> authority granted the City Manager. <br /> The primary concern when exercising this authority is to prevent personal injury, property <br /> damage and inconvenience to the public resulting from improper construction practices <br /> and right-of-way uses by contractors, public utilities, public agencies and property owners. <br /> The objective is to accomplish this without discouraging reasonable requests for public <br /> and private improvements and special uses of the public way. <br /> Utility & RNV Permit Policy 1 12/01/97 <br /> <br />
