<br /> ~ <br /> M <br /> ADMINISTRATIVE ORDER NO. 58-97-21 <br /> of the <br /> Ciity Manager of the City of Eugene <br /> PROPOSED AMENDMENT AND ADOPTION OF <br /> CO STRUCTION WlTHlN AND USE OF THE PUBLIC WAY <br /> E ERGENCY RULE R-7.302 AS A PERMANENT RULE <br /> AN REPEAL OF ADMINISTRATIVE ORDER NO. 58-97-08. <br /> The City attager of the City of Eugene f+nds that: <br /> A. Pu uant to the authority of Section 2.019(5) of the Eugene Code, 1971, on <br /> .lu e 5, 1997 t e iCity Manager issued Administrative Order No. 58-97-08 adopting <br /> nstruction Wit in' and Use of the Public Way Emergency Rule R-7.302. <br /> B. I p ppse to amend Rule R-7.302 to: (a) add a definition for "conduit" and <br /> end the defini ion of "street segment" in R-7.302-B; (b) revise the notice requirements <br /> in -7.302-C to larify the purpose and intent of notification and requiring providers to <br /> ~s ablish the timi g and format of the notice with evaluation and monitoring by the City; (c) <br /> re ise R-7.302- -1 by adding "pay telephones" and "associated poles or support <br /> 3tr ctures" to the on-applicable facilities, revise the location standards in R-7.302-D-2; (d) <br /> 2d a provision t R-7.302-E-3 that requires the City Engineer, with input from providers <br /> tp omplete a st Bards development process prior to imposing permit conditions relating <br /> tb tandards for onduit size, capacity to be installed, or the provision of extra capacity; (e) <br /> cue eting the pe ormance bond or security deposit requirements of R-7.302-H-2 for <br /> iss ante of annu I blanket permits; and to adopt Construction Within and Use of the Public <br /> V~V y Emergency Rule R-7.302, as amended herein, as a permanent rule. <br /> Now, the efore, based on the above findings, 1 hereby propose to adopt the <br /> fiol owing Constr coon Within and Use of the Public Way Rule R-7.302 to provide: <br /> CO STRUCTION WITHIN AND USE OF THE PUBLIC WAY <br /> ADMINISTRATIVE RULE R-7.302 <br /> .302-A Construction Within and Use of the Public Way - Policx <br /> In order t create attractive and healthy neighborhood environments and to protect <br /> th public's right or safe unobstructed use of the public way, applicants wishing to perform <br /> ~ struction in, ruse the public way, shall first obtain a written permit and shall conform <br /> rNi h the standa ds and procedures provided far in these rules and the provisions, <br /> s ecifications, a d conditions contained within the manual on Utility and Right-of-Way <br /> A ministrative rder - 1 11/03/97 <br /> <br />
