l <br /> ADMINISTRATIVE ORDER NO. 58-98-10-F <br /> of the <br /> j City Manager Pro 11em of the City of Eugene <br /> AMENDING MWMC PROVISIONS OF <br /> SYSTEMS DEVELOPMENT CHARGE METHODOLOGY <br /> The City Manager Pro Tem of the City of Eugene finds as follows: <br /> A. S tions 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager of the City <br /> o Eugene to det rmine and set fees and charges to be imposed by the City for services, goods, use of <br /> unicipal prope ,and licenses and permits, and specifically systems development charges. Section 7.710 <br /> o the Eugene Cod , 1971 further authorizes the Ciry Manager to adopt and/or amend by administrative order, <br /> e methodologies used for establishing the systems development charges, and provides this may be effected <br /> c ncurrent with establishment or revision of a systems development charge. <br /> I B. In accordance with the procedures set forth therein, on May 27, 1998, I notified the Mayor <br /> d City Councilo s that I intended to amend the Systems Development Charge Methodology relating to the <br /> etropolitan Wast water Management Commission (MWMC) by increasing fees for the Regional Wastewater <br /> S stems Develop ent charge, eliminating the shopping center category from the rate table as this type of <br /> e tablishment is re accurately described by other categories in the table, and updating the MWMC credit <br /> ble. MWMC as completed an annual update of the value of its assets, the value of proposed future <br /> i provements, an the value of prior property tax payment contributions for existing vacant land. These <br /> c~ianges are the b sis for the proposed increase in the MWMC SDC rates. <br /> <br /> i C. a Notice was also posted in four public places within the City and published in the Register <br /> Quard, a newspa r~gfgeneral circulation within the City on May 27, 1998 and June 8, 1998. The Notice <br /> ovided that wri en comments could be submitted thereon for a period of 30 days from the date of posting <br /> aid publication. o comments were received within the time or in the manner required by the Notice. <br /> D. I and that the revisions to the Systems Development Charge Methodology and the fees as set <br /> f rth in Exhibit ('Izable 1-page 3, Table 5- page D-9, Attachment 3-page D-10, Attachment 4-page D-11, <br /> alculations-page -4, and Section 2.3-page G-6) hereto are consistent with adopted policies and ordinances <br /> the City, in co ormity with applicable state law, and should be implemented effective July 1, 1998. Those <br /> ortions of the Sy ems Development Charge Methodologies adopted by Administrative Order No. 58-97-02- <br /> <br /> ! -2 and Administ ative Order No. 58-97-07-F, in conflict herewith should be amended as of that effective <br /> late. <br /> On the ba is of these findings, I order that: <br /> 1. T e MWMC provisions of the Systems Development Charge Methodology, the MWMC <br /> redit Table, an the rate table are hereby amended as set forth in Exhibit A, including the attachments <br /> t ereto, which ar attached hereto and incorporated herein by reference effective July 1, 1998. <br /> 2.
