This action is being taken based on the recommendations of the Bridge <br /> Engineering Section of the Oregon Department of Transportation. The <br /> recommendations are contained in a letter, dated December 18, 1998, from <br /> ODOT to the City of Eugene. A copy of the letter is attached. <br /> (c) ther recognized traffic control standards. <br /> ? Signing and markings will comply with Manual on Uniform Traffic Control <br /> Devices standards. <br /> ? Section 810.030 (3) of the Oregon Vehicle Code requires that weight limit and <br /> other roadway restrictions be imposed by a proper order, and that the restrictions <br /> are effective when signs giving notice of the restrictions are erected. <br /> (d) The city's adopted transportation-related plans and policies. <br /> ? No transportation-related plans and policies are applicable to this action. <br /> (e) Existing state and local laws regulating use of public ways. <br /> <br /> ~r ? Provisions of the Oregon Vehicle Code will continue to apply after the changes <br /> have been made. Specifically, Section 810.030 (1) of the Code states: "A road <br /> authority may impose restrictions described under this section on its own <br /> highways as ...necessary to (a) Protect any highway or section of highway <br /> from being unduly damaged. (b) Protect the interest and safety of the general <br /> public." 810.030 (2) states: "Restrictions that may be imposed ...include <br /> (b) Imposing limits on any weight of any vehicle or combination of vehicles. <br /> (c) Imposing any other restrictions that the road authority determines necessary to <br /> achieve the purpose of this section." <br /> (f) The efficient use of the public way by the public. <br /> ? The restrictions will require re-routing of vehicles with a gross weight of over <br /> five tons. This will affect LTD buses and some trucks, and thus will have an <br /> adverse effect on the use of the public way by the public. <br /> (g) The use of abutting property. <br /> ? This action will have no effect on the use of the abutting properly, as the abutting <br /> property is undeveloped. <br /> I <br /> I <br /> <br />
