i <br /> ADMINISTRATIVE ORDER NO. 58-99-16-F-2 <br /> <br /> r~ of the <br /> City Manager of the City of Eugene <br /> I <br /> AMENDING THE SYSTEMS DEVELOPMENT CHARGE (SDC) <br /> METHODOLOGY AND MWMC REGIONAL WASTEWATER SDC FEES AND <br /> CREDITS, AND REPEALING ADMINISTRATIVE ORDER <br /> ~ NOS. 58-97-02-F, 58-97-07-F, 58-98-10-F and 58-99-16-F-1. <br /> ~ ' The City Manager of the City of Eugene finds as follows: <br /> I <br /> A. Sections 2.020 and 7.705 of the Eugene Code, 1971 authorize the City <br /> ~ Manager of the City of Eugene to determine and set fees and charges to be imposed by <br /> i the City for services, goods, use of municipal property, and licenses and permits, and <br /> specifically systems development charges. Section 7.710 of the Eugene Code, 1971 <br /> ~ further authorizes the City Manager to adopt and/or amend, by administrative order, the <br /> ~ methodologies used for establishing the systems development charges, and provides this <br /> may be effected concurrent with the establishment or revision of a systems development <br /> charge. <br /> B. In accordance with the procedures set forth therein, on July 1, 1999, I notified <br /> tthe Mayor and City Councilors that I intended to amend the City of Eugene SDC <br /> Methodology previously adopted and/or amended by Administrative Order Nos. 58-97-02- <br /> ~ F, 58-97-07-F, and 58-98-10-F, by revising the local wastewater SDC; increasing the local <br /> transportation, stormwater, and parks SDCs by a 7.3% inflationary adjustment; and <br /> revising the regional Metropolitan Wastewater Management Commission (MWMC) <br /> wastewater SDC fees and credits, as calculated by MWMC. <br /> C. The Notice was also posted on July 2, 1999 in four public locations and <br /> published on July 4, 1999, in the Register Guard, a newspaper of general circulation within <br /> the City. In addition, copies of the Proposed Amendments to the Systems Development <br /> ~ Charge Methodology were made available for inspection by interested persons at the City <br /> Manager's Office, 777 Pearl Street, Room 105, the Public Works Building Lobby, 858 Pearl <br /> Street, the Permit & Information Center, 99 West 10th Avenue, and the Eugene Public <br /> Library, 100 West 13th Avenue, during normal business hours (8:00 a.m. to 5:00 p.m., <br /> Monday through Friday, exclusive of holidays). The Notice provided that written comments <br /> could be submitted thereon for a period of 30 days, through August 3, 1999. No written <br /> ~ comments were received. Oral comments were received from the Public Works Rates <br /> ' Advisory Committee and staff during the public comment period and are addressed in <br /> Finding F below. <br /> D. In addition to the oral comments received during the public comment period <br /> j specific to this Administrative Order, oral testimony was given by two citizens at the August <br /> 9, 1999 public hearing before the City Council in regards to revisions to the ordinance <br /> Administrative Order - 1 <br /> <br />
