I ADMINISTRATIVE ORDER N0.58-99-20 <br /> of the <br /> <br /> ~1r? City Manager of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED INCREASE IN <br /> MWMC SEPTAGE USER FEES <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the City <br /> Manager to determine and set fees and charges to be imposed by the City for wastewater service, <br /> regional wastewater service, and stormwater service. In accordance with the procedures set forth <br /> therein, on June 26,1998, Administrative Order No. 58-98-11-F establishing sewer user rates for the <br /> fiscal year commencing July 1, 1998 was adopted. <br /> B. The MWMC has proposed to increase the septage user charge for MWMC wastewater <br /> service. In July 1998 there was a surcharge added to the rate to cover costs for improvements to <br /> the septage facility, which will expire on September 30, 1999. The proposed rate was established <br /> by surveying other wastewater facilities that accept septage discharge throughout the state and <br /> averaging the rate charged by those agencies. At the August 18, 1999 MWMC meeting the <br /> Commission approved the policy of setting septage rates at market levels, and adopted the proposed <br /> rates. <br /> C. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have conducted an <br /> investigation of the revenue needs of the City in providing these services and reviewed the <br /> recommendation of the Metropolitan Wastewater Management Commission (MWMC). <br /> j D. Based on that investigation and recommendation, Iintend to revise the septage user <br /> "fees for MWMC wastewater service as set forth in the Notice of Intended Fees attached as Exhibit <br /> A hereto and incorporated herein by reference. I find the proposed fees are in compliance with the <br /> Council's directive that the costs of providing such services be recovered from the beneficiaries of <br /> j the services, are consistent with applicable federal and state regulations and the recommendations <br /> of MWMC, and should be implemented effective on all bills issued after November 1, 1999. <br /> Wastewater rates other than the septage rates will remain unchanged. Only those portions of the <br /> ~ wastewater and stormwater rate schedules adopted by Administrative Order No. 58-96-10-F in <br /> conflict herewith should be amended as of that effective date. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, the news media, <br /> ' any person who has requested notice, to interested governmental agencies (including the United <br /> States Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br /> the Eugene Water.& Electric Board), posted at two locations at City Hall, published on two separate <br /> i <br /> ' Administrative Order - 1 <br /> r:~adminord\feeslmwmcseplao.wpd(09/13/99) <br /> <br />
