ADMINISTRATIVE ORDER NO. 58-00-01 <br /> of the <br /> City Manager of the City of Eugene <br /> <br /> i <br /> PROPOSING AMENDMENTS TO AND RENAMING OF TREE <br /> PRESERVATION ADMINISTRATIVE RULE R-6.305 <br /> The ity Manager of the City of Eugene finds that: <br /> A. Sections 6.305 through 6.330 of the Eugene Code, 1971, contain the permit <br /> requirement ,application procedure, and appeal process relating to the City's tree preservation <br /> program. S ction 2.019 authorizes the City Manager to adopt rules for implementation of any <br /> provisions o that Code. <br /> B. In accordance with the procedures set forth therein, Administrative Order No. 58-96- <br /> 22-F was ad ted on February 28, 1997, amending Tree Preservation Administrative Rule R-6.305 <br /> and repealin prior administrative orders. <br /> C. Since adoption of Administrative Order No. 58-96-22-F, changes have occurred with <br /> respect to so a of the City's administrative practices associated with this program, and I therefore <br /> intend to ren a the rule and amend the definitions, permit requirements, application procedure, <br /> criteria for p 't approval, permit issuance, and the exceptions provisions of Administrative Rule <br /> R-6.305 tom re accurately reflect those practices, and add new provisions relating to enforcement <br /> and computa 'on of the administrative civil penalty, as set forth herein and in the Notice of Intended <br /> Rulemaking ttached as Exhibit A hereto. <br /> There ore, based upon the above findings, and pursuant to the authority of Sections 2.019 of <br /> the Eugene ode, 1971, the City Manager proposes to: <br /> Ren e, and amend Tree Preservation Administrative Rule R-6.305 as follows: <br /> TREE REMOVAL PERMIT PROGRAM <br /> ADMINISTRATIVE RULE R-6.305 <br /> R-6.305-A DEFINITIONS. <br /> As us d herein, the following words and phrases mean: <br /> City Manager.
