1.E.2 Internal Public Works Locate Requests For Maintenance Activities <br /> Locate requests placed with the Utility Notification Center for the various types of maintenance <br /> work to be performed by City of Eugene Public Works staff shall be treated in a manner similar to <br /> those locates performed for agencies or individuals issued aright-of--way permit, with the following <br /> exception. Because the research has already been done, Maintenance Division personnel do not <br /> research the existing underground facilities. Upon specific request, the Inspector will research and <br /> field-locate all wastewater and stormwater facilities for maintenance work to be performed by <br /> Maintenance and Transportation Division crews. <br /> Section 2: PERMITS FOR WORK WITHIN THE PUBLIC WAS <br /> 2.A GENERAL <br /> <br /> No person, franchised utility, or municipal utility shall perform work affecting the public way <br /> without first obtaining a permit from the City Engineer. EC 7.290(2} <br /> As used herein, "work affecting the public way" includes, but is not limited to, installation, or <br /> construction of any structure, pipe, conduit, culvert, or facility, including a communications facility <br /> or other wire line facility in the public way, and any construction, reconstruction, grading, dust <br /> control, repair, opening or excavation of a public way for any purpose but does not include the <br /> construction of public improvements performed under a contract executed by the City Manager or <br /> work performed by City employees under the City Manager's direction. EC 7.290(1) <br /> Issuance of a permit for work within the public way does not relieve the permittee from the <br /> responsibility to obtain other necessary permits and to conform to other regulatory requirements. <br /> In certain areas of the public way, location restrictions, setbacks, natural resource preservation, <br /> wetland, or other local, state, or federal regulations may apply. For example, a separate erosion <br /> prevention permit may be required, in addition to aright-of--way cut permit, for work performed in <br /> the public way. EC 6.635(1). If an erosion permit is required, no other permits will be issued prior <br /> to the approval of the erosion permit, Administrative Rule R-6.645 (5). <br /> Individual permits that fit the criterion of street and right-of--way work permits include, but are not <br /> limited to, Right-of--Way Cut Permits, Right-of--Way Use Permits, Utility Right-of--Way Use Permits, <br /> Tree Removal Permits, and Temporary Surfacing Permits. <br /> While not required by the Eugene Code, an adopted City of Eugene policy requires work within the <br /> public way which is to be performed under a contract executed by the City Manager to be reviewed <br /> by Public Works staff and a permit to be issued.
