ADMINISTRATIVE ORDER N0.58-01-10-F O D <br /> <br /> 4~, of the <br /> City Manager of the City of Eugene <br /> AMENDMENT OF MWMC WASTEWATER USER FEES AND <br /> REPEAL OF ADMINISTRATIVE ORDER N0.58-99-20-F. . <br /> The C ty Manager of the City of Eugene finds as follows: <br /> A. Section 6.411 (formerly Section 7.020) of the Eugene, Code,1971 authorizes the City <br /> Manager to d termine and set fees and charges to be imposed by the City for wastewater service, <br /> regional avast water service, and stormwater service. <br /> B. In accordance with the procedures set forth therein, on June 4, 2001, I issued <br /> Administrativ Order No. 58-O1-10 proposing an increase in MWMC wastewater user fees as set <br /> forth in the N tice attached thereto, and the revision of the rates adopted by Administrative Order <br /> ~ No. 58-99-20 <br /> C. Copies of the Notice were provided to the Mayor and City Councilors, the news <br /> media, any p son who had requested notice, and posted at two locations at City Hall on June 8, <br /> f j 2001. The N tice was also published in the Register Guard, a newspaper of general circulation <br /> ,within the Ci , on June 8 and 13, 2001, and made available for inspection by interested persons at <br /> the offices of e Public Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal <br /> business hour (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). The notice <br /> was also prov' ed to interested governmental agencies (including the United States Environmental <br /> Protection Ag ncy, the Department of Environmental Quality, MWMC, and the Eugene Water & <br /> Electric Boar <br /> D. The Notice provided that written comments thereon could be submitted for a period <br /> of 10 days fro the first date of publication and posting, or at a public hearing to be held on June <br /> 19, 2001. No written comments were received within the time or in the manner required by the <br /> E notice. <br /> E. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have conducted an <br /> investigation f the revenue needs of the City in providing these services and reviewed the <br /> recommendat' n of the Metropolitan Wastewater Management Commission (MWMC). <br /> i <br /> F. Based on that investigation and recommendation, and the findings set forth herein, <br /> I find the prop sed wastewater user fees are in compliance with the Council's directive that the costs <br /> of providing s ch services be recovered from the beneficiaries of the services, and other applicable <br /> ~ policies and di ectives of the Council; are consistent with applicable federal and state regulations and <br /> the recommen ations of MWMC; aze comparable to the amounts charged by the City of Springfield <br /> and other suc service providers; and aze based on the proposed budgets of the City and MWMC. <br /> Administrativ Order - 1 <br /> C:\WINDOWS\TE O1 Wastewater2ao.wpd <br /> <br />
