ADMINISTRATIVE ORDER N0.58-O1-18 of the City Manager of the City of Eugene CONCERNING NOTICE OF INTENDED AMENDMENT OF FEES FOR RIGHT-OF-WAY CUT PERMITS AND REPEAL. OF ADMINISTRATIVE ORDER N0.58-97-09-F. The ity Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine and set fees d charges to be imposed by the City for services, goods, use of municipal property, and license and permits. In accordance with the procedures set forth therein, and the further authority of ection 7.300 of the Eugene Code, 1971, Administrative Order No. 58-97-09-F was adopted on J e 26,1997, establishing right-of--way use permit fees. A portion of the fee schedule adopted by iministrative Order No. 58-97-09-F was subsequently amended and is incorporated in the fee sch ule adopted by Administrative Order No. 53-01-07-F. This order proposes an amendment t the fees not included in the schedule attached to Administrative Order No. 53-01-07- F. B. The Utility Permit Program has an objective to recover the full costs associated with fir, permitting inspection. Fees necessary to achieve full cost recovery have been calculated by City staff. Based on this calculation, an increase in permit and project fees is necessary in order to recover the 11 costs of the utility permit program, which staffhas recommended be phased in over a three-year rind. The proposed permit fees as set forth in Exhibit A hereto, should begin, for the first calendar year, upon the effective date of the final Administrative Order amending these fees, and for the s and calendar year, should begin January 1, 2003. During the calendar year 2003, an updated revie of program costs will be performed by staff and recommendations made with respect to the fees re uired to recover full program costs. Those fees would become effective January 1, 2004, or as pr vided in the administrative order adopting the fees. In addition to the proposed fees, the reference hould be amended to read "Utility Right-of--Way Use Permit Fees." C. I have reviewed and concur with the staff's recommendations. The fees set forth in Exhibit A h eto are consistent with applicable policies and directives of the City Council, comparable t ~ the fees established in other jurisdictions for providing such services, and are necessary in o der to comply with the City Council's directive and the requirements of Section 7.300 of the Eugene Code, 1971, that all of the City's costs related to processing the applications for the permits and i pecting the work during and after completion of the work be fully recovered.
