i. <br /> <br /> r <br /> ! <br /> ~ ' ADMINISTRATIVE ORDER N0.58-02-17-F <br /> of the <br /> i City Manager pro tem of the City of Eugene <br /> AMENDMENT TO THE WASTEWATER USER FEE <br /> SCHEDULE BY INCREASING THE MWMC SEPTAGE <br /> HAULER FEE AND REPEAL OF ADMINISTRATIVE ORDER <br /> ! ~ N0.58-01-10-F. <br /> The City Manager pro tem of the City of Eugene finds as follows: <br /> A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971, authorizes the <br /> ! ~ !City Manager to determine and set fees and charges to be imposed by the City for wastewater <br /> + service, regional wastewater service, and stormwater service. <br /> i <br /> i <br /> B. In accordance with the procedures set forth therein, on May 30, 2002, I issued <br /> j Administrative Order No. 58-02-17, and notified the Mayor and City Councilors that I intended to <br /> ! increase the MWMC sanitary sewer fee for septage haulers, as set forth in the Notice attached <br /> thereto, which had been adopted by Administrative Order No. 58-01-10-F on June 21, 2001. <br /> ! ~ C. Notice was also provided to the news media, any person who had requested notice, <br /> I4 and to interested governmental agencies (including the United States Environmental Protection <br /> I Agency, the Department of Environmental Quality, MWMC, and the Eugene Water & Electric <br /> Board). In addition, the Notice was posted at two locations at City Hall on June 3, 2002, and <br /> published on two separate occasions in the Register-Guard, a newspaper of general circulation within <br /> i the Ciry, to wit: June 3 and 4, 2002. The Notice was made available for inspection by interested <br /> E persons at the offices of the Public Works Department, 858 Pearl Street, Eugene, Oregon, 97401, <br /> ~ during normal business hours (8:00 a.m. to 5:00 r.m., Monday through Friday, exclusive ~f <br /> holidays). <br /> G D. The Notice provided that written comments would be received for a period of 10 days <br /> from the first date of publication and posting, or at the public hearing to be held in the Public Works <br /> Department, 858 Pearl Street, Eugene, Oregon, 97401, on June 17, 2002, between noon and 2:00 <br /> i p.m.. No one appeared for the public hearing and no written comments were received within the <br /> ! time or in the manner required by the Notice. <br /> f <br /> E. Pursuant to subsection (1) of Section 6.411 of the Eugene Code, 1971, I have <br /> conducted an investigation of the revenue needs of the City in providing these services and have <br /> reviewed the recommendation of the Metropolitan Wastewater Management Commission (MWMC). <br /> f F Based on my investigation and MWMC's recommendation, and the findings set forth <br /> herein, I find that the proposed MWMC sanitary sewer fee for septage haulers is in compliance with <br /> the Council's directive that the costs of providing such services be recovered from the beneficiaries <br /> i <br /> Administrative Order -Page 1 <br /> C:\WINDOWS\Temporary [ntemet Files10LK6IA5\02SeptageHaul-2ao.wpd <br /> <br />
