ADMINISTRATIVE ORDER N0.58-02-24 ~
~J ~::y. i1 . U
of the
City Manager pro tem of the City of Eugene
j i CONCERNING NOTICE OF INTENDED AMENDMENT OF
WETLANDS MITIGATION BANK FEE.
,I
The City Manager pro tem of the City of Eugene finds as follows:
A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine
~ ~ and set fees and chazges to be imposed by the City for services, goods, use of municipal property,
end licenses and permits.
B. The City has an agreement with the Oregon Division of State Lands (ODSL) and U. S.
j Army Corps of Engineers to restore and create wetlands to satisfy mitigation obligations for
development within the City.
i
~ C. The City has been charging $30,000 per acre for mitigation wetlands in order to
recover its costs of developing and maintaining those wetlands. Although the City's costs of
'..developing and maintaining those wetlands has increased, this chazge has remained the same for over
seven years.
D. Based on an evaluation of those increased costs, staff has recommended that the fee
be increased to $50,000 per acre. I concur with that recommendation, and intend to amend the
wetlands mitigation fee as set forth in the Notice of Intended Fees attached as Exhibit A hereto and
incorporated herein by reference.
E. I find that the proposed fee set forth in Exhibit A hereto is consistent with applicable
olicies and directives of the Ci Council to recover the cost of services from the direct beneficiaries
p ty
of those services, has been computed in a manner consistent with the requirements of the City's
j agreement with ODSL and the U.S. Army Corps of Engineers, and is necessary in order to defray
the costs associated with the wetland mitigation program.
' On the basis of these findings, I order that:
1. Copies of the Notice be provided to the Mayor and City Councilors, posted at two
I~
~ ~ locations at City Hall, published in the Register Guard, a newspaper of general circulation within the
City, and be made available for inspection by interested persons at the office of the City Manager,
~ City Hall, 777 Pearl Street, Eugene, Oregon 97401.
i
2. All persons desiring to comment thereon shall submit written comments as set forth
in the Notice. I will thereafter establish the fee as proposed, or as modified in response to the

~ Administrative Order - 1
r:\adminord\fees\02wetlandmitl ao.wpd{08/09/02)
