Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine
and set fees and charges to be imposed by the City for services, goods, use of municipal property,
and licenses and permits.
B. In accordance with the procedures set forth therein, on August 22, 2002, I issued
administrative Order No. 58-02-24 and notified the Mayor and City Councilors that I intended to
increase the wetlands mitigation bank fee in order to recover the costs of developing and maintaining
the wetlands in accordance with the agreement that the City has with the Oregon Division of State
bands (ODSL) andU.S. Army Corps ofEngineers to restore and createwetlands to satisfymitigation
gbligations for development within the City.
C. Notice was also posted at two locations at City Hall and published in the Register .
Guard, a newspaper of general circulation within the City, on August 23, 2002, and made available
for inspection by interested persons at the office of the City Manager, City Hall, 777 Pearl Street,

! Eugene, Oregon 97401. Notice provided that written comments would be received for a period of
15 days from the date of posting and publication. No written comments were received within the
time or in the manner provided in the Notice.
D. Based upon these findings and the findings set forth in Administrative Order No. 58-
b2-24, I find that the Wetlands Mitigation Bank fee of $50,000 per acre is consistent with applicable
policies and directives of the City Council to recover the cost of services from the direct beneficiaries
pf those services, has been computed in a manner consistent with the requirements of the City's
agreement with ODSL and the U.S. Army Corps of Engineers, and is necessary in order to defray
the costs associated with the wetland mitigation program.
i
On the basis of these findings, I order that:
The Wetlands Mitigation Bank fee to be charged as of the effective date of this Order is
50,000 per acre.
Dated anal effective this Gin' day of September, 2002.
i~ ~
ames R arlson
City Manager pro tem
Administrative Order
C:\TEMP\02wetlandmit2ao.wpd
