Administrative Order No. 58-03-14 <br /> Public Works Department <br /> City of Eugene, Oregon <br /> EME GENCY RULE AMENDING RULE 1.007 OF THE CITY'S PARK <br /> RUL SAS ADOPTED BY ADMINISTRATIVE ORDER NO. 58-98-16-F. <br /> The xecutive Director of the Public Works Department of the City of Eugene finds <br /> that: <br /> A. Pursuant to the prior authority of Section 2.812 et se .of the Eugene Code, 1971, <br /> (subsequentl repealed) which authorized the City Manager or designee to adopt Park Rules, and <br /> Administrati e Order No. 58-92-21 delegating authority for adoption of Park Rules to the Director <br /> ofthe Public orks Department, on June 24, 1994, Administrative Order No. 58-94-12 was issued <br /> adopting am nded Park rules. Those rules have subsequently been amended, most recently by <br /> Administrati e Order No. 58-98-1 b-F, issued on October 20, 1998. <br /> B. Substantial amendments to the Park Rules are currently being developed to address <br /> numerous is ues that have arisen since the adoption of the 1998 amendments.. The proposed <br /> amendments which include revisions to Rule 1.007 (Possession or Consumption ofMalt Beverages <br /> and Alcoholi Liquor), are being reviewed by affected City departments and are not ready to be <br /> processed at his time. <br /> C. With the advent of warmer weather there has been an increase in the use of City parks <br /> and park fac" ities. There has also been a significant increase in the number of people consuming <br /> malt beverag sand alcoholic liquor in park structures in a manner that adversely impacts the public's <br /> use and enjo ent of the park facilities. Amending Rule 1.007 of the Pazk Rules at this time will <br /> allow staff to continue their review of the remaining amendments to the Park Rules while addressing <br /> the alcohol c resumption issues that need to be immediately addressed in order to protect the public's <br /> ability to us and enjoy the park facilities. <br /> D. Adoption of this Emergency Rule is authorized by Subsection 2.019(6) of the Eugene <br /> Code, 1971, and failure to act promptly in effecting this amendment will seriously prejudice the <br /> public intere t in the use and enjoyment of City park facilities. This amendment should therefore <br /> be immediat ly effective. <br /> Ther fore, based upon the above findings, and pursuant to the authority of Section 2.019(6) <br /> of the Euge e Code, 1971, Park Rule 1.007 is hereby amended to provide: <br /> 1.007 POSSESSION OR CONSUMPTION OF HARD LIQUOR, MALT <br /> BEVERAGES AND ALCOHOLIC LIQUOR <br /> (1) Definitions.
