ADMINISTRATIVE ORDER NO. ~ g ~ ~ ~ ~q <br /> of the <br /> City Manager of the City of Eugene <br /> CON ERNING NOTICE OF PROPOSED ADOPTION OF INDEXING OF <br /> EQ ALENT ASSESSMENT RATES ADMINISTRATIVE RULE R-7.407. <br /> The ity Manager of the City of Eugene finds as follows: <br /> A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt rules <br /> and regulatio s necessary for the administration or enforcement of provisions of the Eugene Code, <br /> 1971. <br /> B. Chapter 7 of the Eugene Code, 1971 ("EC") contains the general provisions <br /> governing th initiation, construction, and assessment for local improvements, including provisions <br /> <br /> ' that authoriz the deferral or modification of assessment payments, and imposition of a delayed, or <br /> equivalent as essment. Under EC 6.476(1} an owner who proposes to connect property to a City <br /> wastewaters wer who has not previously paid a local improvement assessment for that wastewater <br /> sewer, is req fired to pay an equivalent assessment prior to the connection being authorized. Similar <br /> provisions f imposition of an equivalent assessment for street improvements are set forth in EC <br /> 7.407. <br /> C. Those provisions provide that when a local improvement has been constructed by the <br /> City and an equivalent assessment is to be imposed, the City Engineer shall, to the degree <br /> practicable, stablish the equivalent assessment rate based on the actual cost of the improvement <br /> when it was onstructed, plus an indexing factor to bring the historic costs up to date. <br /> D. The City Engineer has recommended the adoption of a methodology and formula for <br /> computation and indexing of equivalent assessments and their implementation. I have reviewed and <br /> concur with the City Engineer's recommendation and find that adoption of the Indexing of <br /> Equivalent ssessment Rates Administrative Rule R-7.407 as hereinafter set forth is necessary in <br /> order to pro fide uniformity and clarity in the computation of equivalent assessments and their <br /> implementa on. <br /> Base on the above findings, I hereby propose to adopt the following: <br /> INDEXING OF EQUIVALENT ASSESSMENT RATES <br /> ADMINISTRATIVE RULE R-7.407 <br /> R-7.407-A Definitions. <br /> As ed in this Rule, the following words and phrases•are defined as follows: <br /> Administra ve Order - 1 <br /> <br />
