II Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971, <br /> authorizes the City Manager to determine and set fees and charges to be imposed by the <br /> City for wa tdwater service, regional wastewater service, and stormwater service. <br /> B. In accordance with the procedures set forth therein, on May 24, 2004, I <br /> issued Ad inistrative Order No. 58-04-12, and notified the Mayor and City Councilors that I <br /> intended t increase the Wastewater User Fee Schedule established by Administrative <br /> Order No. 5~-03-09-F on July 17, 2003, as set forth in the Notice attached thereto, <br /> fter Jul 1 2004 exce t for all se to a hauler fees which <br /> ed on or a P 9 <br /> r ahl bills issu P <br /> effective f Y <br /> will be eff ctive for all septage hauler charges incurred on or after July 1, 2004. <br /> ' C. ' Notice was also provided to the news media, any person who had requested <br /> notice a d to interested overnmental agencies (including the United States <br /> n 9 . <br /> ! Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br /> the Eugenie Water & Electric Board). In addition, the Notice was posted at two locations at <br /> City Hall do May 28, 2004, and published on two separate occasions in the Register- <br /> ~ Guard, a ~ evuspaper of general circulation within the City, on May 28 and 29, 2004. The <br /> Notice wa~ made available for inspection by interested persons at the offices of the Public <br /> Works De artment, 858 Pearl Street, Eugene, Oregon, 97401, during normal business <br /> hours (8:0 ~.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br /> D. I The Notice provided that written comments would be received for a period of <br /> ten days f orb the first date of publication and posting, and that comments would also be <br /> received t the public hearing to beheld in the Public Works Department, 858 Pearl Street, <br /> Eugene, r~gon, 97401, on June 10, 2004, between noon and 1:00 p.m.. No written <br /> comment were received during the ten-day comment period. Five people testified at the <br /> public he ring. One person supported the rate increase. Four people were opposed to the <br /> t rate incre se, to which I make the following findings: <br /> Co ent 1: Dick Beers testified that he was opposed to the increase. He felt that <br /> mone~r was being spent inappropriately on land acquisition for the "storm <br /> wa tewater" fee.
