<br /> ::I <br /> ADMINISTRATIVE ORDER NO. 5&0416-F <br /> of the <br /> AIRPORT MANAGER <br /> AMENDiMENT OF SECTIONS 4 AND 5 OF THE AIRPORT FEE <br /> SCHEDI~ILE AND REPEAL OF ADMINISTRATIVE ORDER NOS. <br /> 58-0401rF AND SS-0410.F. <br /> The Airport Manager of the City of Eugene finds as follows: <br /> A. Authority is granted to the City Manager of the City of Eugene under Sections 2.440 <br /> to 2.442 of the Eugene Code, 1971 to set fees and charges for the use of the Eugene Airport. The <br /> City Manager further delegated that authority to the Airport Manager under Airport Rule 8.4.2. <br /> B. suant to that delegated authority, on August 2, 2004, I issued Administrative Order <br /> No. 58-04-16, d notified the Mayor and City Council that I intended to amend the Airport Fee <br /> Schedule estab shed by Administrative Order No. 58-04-O1-F on Febroary 12, 2004, and <br /> subsequently am ded by Administrative Order No. 58-04-10-F on Apri116, 2004, as set forth in the <br /> Notice attached .as Exhibit A thereto. <br /> C. l~totice was also posted at two locations at the Airport and published in the Register <br /> Guard, a newspi~per of general circulation within the City, on August 2, 2004, provided to persons <br /> who had reques~ed notice, persons who are currently paying such charges, and was made available <br /> for inspection bx interested persons at the offices of the Airport Manager, 288SS Lockheed Drive, <br /> Eugene, Oregot4 97402 during normal business hours (8:00 a.m. to 5:00 p.m., Monday through <br /> Friday, exclusiv~ of holidays). <br /> D. otice provided that written comments would be received for 1 S days from the date <br /> of posting and blication. No comments were received within the time or in the manner described <br /> in the Notice. <br /> E, ased upon the above findings and the findings in Administrative Order No. S 8-04-16, <br /> and after invest gating the amoum charged for such use in the past; comparable amounts or rates <br /> charged by oth airports; the amounts or rates and other municipal benefits agreed to by comparable <br /> users of the ort in a contract, lease, or permit; and, the revenue needs of the airport, I have <br /> determined thatithe Airport Fee Schedule should be amended as proposed.
