i <br /> ADMINISTRATIVE ORDER N0.58-05-04 <br /> of the <br /> City Manager of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED AMENDMENT TO <br /> THE WASTEWATER USER FEE SCHEDULE AND REPEAL <br /> ~ OF ADMINISTRATIVE ORDER NO. 58-04-12-F. <br /> i The City Manager of the City of Eugene finds as follows: <br /> i <br /> A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971, <br /> authorizes the City Manager to determine and set fees and charges to be imposed by the <br /> City for wastewater service, regional wastewater service, and stormwater service. <br /> i <br /> ~ B. Pursuant to subsection (1) of Section 6.411 of the Eugene Code, 1971, I <br /> have c onducted a n i nvestigation o f t he r evenue needs of the City in providing these <br /> services and have reviewed the recommendation of the Metropolitan Wastewater <br /> ~ Mlanagement Commission (MWMC). The proposed increases are necessary in order to <br /> comply with the Council's directive that the costs of providing such services be recovered <br /> from the beneficiaries of the services, and other applicable policies and directives of the <br /> j City Council; are consistent with applicable federal and state regulations; are comparable <br /> ~ to the amounts charged by the City of Springfield and other such service providers for <br /> comparable services; preserve the equity between different classes of ratepayers; and are <br /> based on the proposed budget of the City. <br /> C. Based on that investiga#ion and MWMC's recommendation, lintend to <br /> increase t he wastewater u ser f ees as set forth in the Notice of Intended Increase in <br /> i VI/astewater Service Charges attached as Exhibit A hereto and incorporated herein by <br /> reference. The increase should be implemented and effective for all bills issued on or after <br /> i .duly 1, 2005. <br /> On the basis of these findings, I order that: <br /> I <br /> ~ 1. Copies of the Notice be provided to the Mayor and City Councilors, the news <br /> media, any person who has requested notice, to interested governmental agencies <br /> (including the United States Environmental Protection Agency, the Department of <br /> j Environmental Quality, the Metropolitan Wastewater Management Commission, and the <br /> Eugene Water & Electric Board), posted at two locations at City Hall, published on two <br /> separate occasions in the Register Guard, a newspaper of general circulation within the <br /> j City, and be made available for inspection by interested persons at the offices of the Public <br /> i Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business <br /> hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). <br /> 2. The Notice shall provide that all persons desiring to comment on the <br /> Administrative Order -Page 1 <br /> <br /> ~r <br /> <br />
