r <br /> ADMINISTRATIVE ORDER NO.58-06-03 <br /> of the Y4 <br /> City Manager of the City of Eugene i <br /> CONCERNING NOTICE OF INTENDED AMENDMENT <br /> TO THE STORMWATER USER FEE SCHEDULE AND <br /> REPEAL OF ADMINISTRATIVE ORDER N0.58-OS-03-F. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. ,Section 6.411 of the Eugene Code, 1971, authorizes the City Manager to determine <br /> and set fees and charges to be imposed by the City for wastewater service, regional wastewater <br /> service, and stormwater service. Pursuant to that authority, on June 2, 2005, I issued Administrative <br /> Order No. 58-OS-03-F amending the Stormwater User Fee Schedule, effective June 12, 2005. <br /> B. In accordance with subsection (1) of Section 6.411 of the Eugene Code,1971, Ihave <br /> conducted an investigation of the revenue needs of the City in providing stormwater services. I <br /> propose to amend the Stormwater User Fee Schedule based on: (1) the amount charged for the <br /> services in the past; (2) applicable federal and state regulations; (3) amounts chazged by the City of <br /> Springfield and other such service providers for compazable services; (4) the 'revenue needs for costs <br /> related to local and regional sewerage facilities; (5) special surchazge rates for stormwater customer <br /> discharging stormwater at extraordinary expense to the City; (6) other relevant adopted policies of <br /> the council; (7) the terms of any applicable intergovernmental agreement relating to stormwater; and <br /> (8) obtaining equity between different classes of ratepayers. <br /> C. Based on my investigation, I propose to amend the stormwater user fees as set forth in <br /> the Notice of Intended Amendment of Stormwater User Fee Schedule attached as Exhibit A. The <br /> amendments should be implemented and effective for all bills issued on or after July 1, 2006. <br /> On the basis of these findings, I order that: <br /> 1. Copies o f the Notice be provided to the Mayor and City Councilors, the news media, <br /> any person who has requested notice, to interested governmental agencies (including the United <br /> States Environmental Protection Agency, the Department of Environmental Quality, the <br /> Metropolitan Wastewater Management Commission, and the Eugene Water & Electric Board), <br /> posted at two locations at City Hall, published on two separate occasions in the Register Guard, a <br /> newspaper of general circulation within the City, and be made available for inspection by interested <br /> persons at the offices of the Public Works Department, 858 Pearl Street, Eugene, Oregon 97401, <br /> during normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). <br /> 2. The Notice shall provide that all persons wanting to comment on the proposed fees <br /> may submit written comments to the City Manager at 777 Pearl Street, Eugene, Oregon 97401 within <br /> 10 days of the first date of publication and posting as indicated in the Notice, or at the public hearing <br /> <br /> Administrative Order -Page 1 <br /> <br />
