r ADMINISTRATIVE ORDER NO.58-06-03 of the Y4 City Manager of the City of Eugene i CONCERNING NOTICE OF INTENDED AMENDMENT TO THE STORMWATER USER FEE SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER N0.58-OS-03-F. The City Manager of the City of Eugene finds as follows: A. ,Section 6.411 of the Eugene Code, 1971, authorizes the City Manager to determine and set fees and charges to be imposed by the City for wastewater service, regional wastewater service, and stormwater service. Pursuant to that authority, on June 2, 2005, I issued Administrative Order No. 58-OS-03-F amending the Stormwater User Fee Schedule, effective June 12, 2005. B. In accordance with subsection (1) of Section 6.411 of the Eugene Code,1971, Ihave conducted an investigation of the revenue needs of the City in providing stormwater services. I propose to amend the Stormwater User Fee Schedule based on: (1) the amount charged for the services in the past; (2) applicable federal and state regulations; (3) amounts chazged by the City of Springfield and other such service providers for compazable services; (4) the 'revenue needs for costs related to local and regional sewerage facilities; (5) special surchazge rates for stormwater customer discharging stormwater at extraordinary expense to the City; (6) other relevant adopted policies of the council; (7) the terms of any applicable intergovernmental agreement relating to stormwater; and (8) obtaining equity between different classes of ratepayers. C. Based on my investigation, I propose to amend the stormwater user fees as set forth in the Notice of Intended Amendment of Stormwater User Fee Schedule attached as Exhibit A. The amendments should be implemented and effective for all bills issued on or after July 1, 2006. On the basis of these findings, I order that: 1. Copies o f the Notice be provided to the Mayor and City Councilors, the news media, any person who has requested notice, to interested governmental agencies (including the United States Environmental Protection Agency, the Department of Environmental Quality, the Metropolitan Wastewater Management Commission, and the Eugene Water & Electric Board), posted at two locations at City Hall, published on two separate occasions in the Register Guard, a newspaper of general circulation within the City, and be made available for inspection by interested persons at the offices of the Public Works Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays). 2. The Notice shall provide that all persons wanting to comment on the proposed fees may submit written comments to the City Manager at 777 Pearl Street, Eugene, Oregon 97401 within 10 days of the first date of publication and posting as indicated in the Notice, or at the public hearing Administrative Order -Page 1
