f <br /> I <br /> ~ EXHIBIT A <br /> FINDINGS IN SUPPORT OF THE ADOPTION <br /> - OF ADMINISTRATIVE ORDER NO. <br /> Introduction <br /> i The City of Eugene is in the process of adding provisions to Chapter 9 of the Eugene Code <br /> (EC), the City of Eugene's adopted land use code, with the intent of protecting life and propem~ from <br /> flood and drainage hazards. reducing the impacts that urbanization is having on the Citv~s water <br /> ~ quality, protecting waterways in the headwater areas from erosive affects of increases in stormwater <br /> ~ runoff, protecting the Citv's stormwater system from oil and grease from stormwater runoff.. and <br /> ~ preventing stormwater pollution by eliminating pathways that may introduce pollutants into <br /> ~ stormwater (hereinafter referred to as "the Proposed Stormwater Regulations"). The Proposed <br /> ' Stormwater Regulations will require that developers comply with standards that are based, in part, on <br /> facilities and methodologies set forth in the Stormwater Management Manual. The Proposed <br /> Stormwater Regulations provide that the Stormwater Management Manual will be adopted by the <br /> City in the manner set forth in EC x.019, City Manager -Administrative and Rulemaking Authority <br /> and Procedures. <br /> This administrative order that adopts the Stormwater Management Manual is a not a land use <br /> regulation. However, the administrative order, that implements the Citv's adopted land use code, is <br /> potentially a land use decision. The City recognizes that state law does not require a local <br /> government to show compliance with the Statewide Planning Goals when makin<. an administrative <br /> land use decision. However, because the administrative order implements an acknowledged land use <br /> j regulation lthe City°'s adopted land use code), the findings set forth below are intended to <br /> demonstrate that the standards are consistent with the Statewide Planning Goals. <br /> Findings of I`:onsistenev with the Statewide Planning Goals <br /> I b . <br /> I <br /> (1) The administrative order is consistent with applicable statewide planninggoals adopted by <br /> ~ ( the Land Conservation and Development Commission. <br /> I( <br /> <br /> i j Coal I - Citisen Involvement.
