i <br /> ' ADMINISTRATIVE ORDER NO.58-06-07-F <br /> of the <br /> Airport Manager <br /> AM)~NDING SECTIONS 4, 5, AND 8 OF THE AIRPORT FEE <br /> SCI~EDULE; RATIFYING UNAMENDED FEES; AND REPEALING <br /> AD1I~INISTRATIVE ORDER N0.58-OS-OS-F. <br /> <br /> I <br /> The ,'Airport Manager of the City of Eugene finds as follows: <br /> A. Authority is granted to the City Manager of the City of Eugene under Sections <br /> 2.440 to 2.442 of the Eugene Code, 1971 to set fees and chazges for the use of the Eugene <br /> <br /> ~ Airport. T1Ye City Manager has further delegated that authority to the Airport Manager under <br /> Airport Rule 8.4.2. <br /> B. Pursuant to that delegated authority, on June 5, 2006, I issued Administrative <br /> Order No. 5~-06-07, and notified the Mayor and City Council that I intended to amend Sections <br /> 4, 5 and $ of the Airport Fee Schedule established by Administrative Order No. 58-OS-OS-F on <br /> July 21, 200, as set forth in the Notice attached as Exhibit A thereto. <br /> C. The Notice was also posted at two locations at the Airport and published in the <br /> Register Gu~rd, a newspaper of general circulation within the City, on June 5, 2006, provided to <br /> persons whd had requested notice, persons who aze currently paying such chazges, and was made <br /> <br /> j available fot inspection by interested persons at the offices of the Airport Manager, 28855 <br /> Lockheed Drive, Eugene, Oregon 97402, during normal business hours (8:00 a.m. to 5:00 p.m., <br /> Monday thrqugh Friday, exclusive of holidays). <br /> D. I The Notice provided that written comments would be received for 15 days from <br /> the date of posting and publication. The following comments were received from Connie Gurich <br /> on behalf of~The Hertz Corporation, to which I make the following fmdings: <br /> Comment 1: We request the CFC (Customer Facility Charge for Car Rentals) be <br /> specifically excluded from concessionable revenue. Would you kindly provide a letter to <br /> that $fI~ect since the Concession Agreement is silent on that point. <br /> Finding: The order proposed the addition of the CFC as a separate fee, with no <br /> <br /> ~ intenlt it become part of a concessionaire's revenue in computing amounts due under a <br /> Concession Agreement. No changes are made as a result of this comment, and the issue <br /> <br /> j will 1be separately responded to. <br /> <br /> i Comment 2: Will the CFC be taxable? We need State opinion on this so that we <br /> properly collect. <br /> Find: Since this determination will need to be made by the state no specific <br /> response or change is necessary. <br /> Comment 3: We will need at least 4 weeks prior notice to program the system <br /> and Start collecting the CFC.
