Even though some of the property to be sprayed appears to be outside the <br /> Ashland city limits, and thus in Jackson County, we do not believe that county lands are <br /> "congested", as contemplated by 14 C.F.R. §137.51(b)(1). It thus does not appear that Jackson <br /> County needs to give approval for the aerial operations. Jackson County therefore waives any <br /> right it may have under that regulation. We believe that the consent of the city of Ashland is the <br /> appropriate consent you need obtain for the proposal.
