Goode of the Circuit Court of Oregon <br />denied all f the complaints made against the city in a lawsuit filed Aug. 10 <br />i <br />by three Ri er Road residents. The lawsuit claimed the city failed to pro- <br />f vide mechan sms which take into account the ability of the residents to pay <br />for sewer s rvices. <br />Judge node found that a series of steps taken by the city -- including <br />', the offer o 10-year financing, the creation of five assessment deferral <br />!I programs, a d acquisition of EPA grants and Lane County road funds to reduce <br />i <br />the cost of the project to property owners -- "amount to a reasonable effort <br />on the part of the City of Eugene to provide a financing mechanism." <br />The ju ge also ruled favorably on the city's large assessment deferral <br />program, wh ch was created to help those River Road property owners who face <br />particularl large assessments for sewer improvements.
