ti <br /> 6.005 Eugene Code 6.007 <br /> Chapter 6 <br /> E N V I R O N M E N T A N D H E A L T H <br /> ~ Nuisances <br /> <br /> ~l <br /> 6.005 Definitions. For purposes of sections 6.005 to 6.527, the follow- <br /> . ing words and phrases mean: <br /> Developed property. A tract of land occupied preponderantly <br /> ' by a structure used or designed for use as a residence or a place <br /> of economic enterprise, by landscaping, by other improvement <br /> accessory to the structure, or by a combination of such land <br /> <br /> j development. <br /> Enforcing officer. Any city employee authorized by the city <br /> manager to enforce the nuisance abatement provisions of this <br /> <br /> { chapter. <br /> Person in charge of property. An agent, occupant, lessee, <br /> tenant, contract purchaser, or other person having possession or <br /> f control of property or the supervision of a construction project <br /> on the property. <br /> j Person responsible. Any or all of the following: <br /> (a) The owner of the property on which the nuisance <br /> exists or the owner of property which abuts a public way <br /> where a nuisance exists. <br /> (b) The person in charge of the property or of property <br /> which abuts a public way where a nuisance exists. <br /> (c) The person who causes the nuisance to come into <br /> or continue in existence. <br /> <br /> 1 t Public way. Any street, road, alley, right-of-way, pedes- <br /> trian or bicycle easement for public use. <br /> Rodent-proof. Any building, structure or part thereof is <br /> "rodent-proof" when it is constructed of concrete, metal or some <br /> equally impermeable material and in a manner that excludes rats <br /> ' and mice therefrom. <br /> ' Vegetation. Plant life, including but not limited to, trees, <br /> shrubs, flowers, weeds and grass. <br /> (Section .005 amended by Ordinance No. 18199, enacted May 31, 1978, and <br /> Ordinance No. 19393, enacted July 28, 1986, effective January 28, 1987.) <br /> 6.007 Nuisances - Prohibition and Responsibility to Abate <br /> (1) No person responsible shall cause or permit a nuisance on <br /> <br /> ~ public or private property. <br /> (2) The person responsible shall be liable for injury, damage or <br /> loss to p rson or property caused by the negligent failure to abate any nuis- <br /> <br /> j ante desc ibed in this code. <br /> (3) The city shall not be liable for injury, damage or loss to any <br /> i person or property caused in whole or in part by the failure of the person <br /> responsib a to comply with subsection (1) of this section, or by the failure <br /> of the ci y as a person responsible to abate a nuisance. <br /> (4) Neither the duty of the person responsible to keep property <br /> free of n isances nor his/her failure to do so is dependent upon notice from <br /> the city o abate the nuisance. <br /> 6-1 02/16/87 <br /> <br />
