SECTION 5 TERMS AND CONDITIONS <br /> By submitting this EWEB EV Program Application(Application),i agree,understand and have met the following terms and conditions: <br /> 1. The EWEB Electric Vehicle Commercial Rebate('Program')is a limited time Program to assist EWEB customers with the purchase and installation costs <br /> for qualifying EV charging infrastructure(s)installed in EWEB's service territory.The effective date of the Program is October 3r4,2016 and expires <br /> December 31,2016.Only purchases/leases made on or after the effective date are eligible. The Program offering may change during the program term <br /> and is based on offering at time of submission. This Program may be modified or terminated by EWER at any time without prior notice. <br /> 2. The vehicle purchased/leased must be DMV registered at a business with an active meter receiving EWES electric service. Vehicle must be a NEW electric <br /> vehicle,FIRST TIME SALE OR LEASE. <br /> 3. Incentive application must be postmarked within 30 days of the date of purchase/lease to be eligible for incentive. Failure to provide appropriate <br /> documentation may result in incentive ineligibility. <br /> 4. The incentive payment shall go directly to the customer listed on the application. Payment cannot be assigned or transferred. <br /> 5. Applications received by EWER with missing documentation or that do not meet the program criteria will not be considered.EWEB is not responsible for <br /> documents lost or destroyed in the mail via transit or misdirected applications.Submitted program application and accompanying documents become the <br /> property of EWER. <br /> 6. Must be a commercial customer with an active electric meter served by EWES on a commercial electric rate.Tenants are responsible for obtaining the <br /> property owners pemiission to install the infrastructure(s). A signature on this Application indicates that permission has been authorized to conduct <br /> business with EWEB regarding this installation. <br /> 7. EWEB may request additional documentation to verify that the applicant meets the criteria for the Program eligibility listed in Section 4 of this Application. <br /> 8. EWEB makes no warranty and is not responsible for any representations,whether expressed or implied,included but not limited to the warranty of <br /> merchantability,fitness,performance,and longevity for any particular purpose,use,or application of the item(s)or measure(s),manufacturers,dealers, <br /> contractors,or any other third parties,materials,workmanship,the quality,safety and/or installation of the item(s)or measure(s),effects on pollutants or <br /> any other matter with respect to the Program.Moreover,EWES shall not be responsible for the workmanship including quality of installation,or the <br /> installer's failure to comply with applicable safety standards as it relates to the installed equipment. <br /> 9. As part of Program acceptance,EWER may utilize data generated by the use of the EV charging to improve EWER services,conduct studies,and any other <br /> purposes in furtherance of EWEB's operations.Such data may also be provided to other entities for research and grant purposes and/or as required by <br /> law. <br /> 10.Implementation and interpretation of the terms and conditions of this program are at the sole discretion of EWEB. <br /> SECTION 6 CUSTOMER SIGNATURE <br /> Customer Certification: i certify the attached documents to this Rebate Application are authentic proof of purchase by me or my <br /> authorized business representative(s)for the referenced herein. I also certify that the information on this Application and the attached <br /> documentation is true and accurate. Upon reasonable notification, I agree to allow EWER to verify both the sales transactions and the <br /> product installation at my facility. I understand that rebates are taxable and may be reported to the IRS.
