Contracts & Agreements <br />No. 21,833 <br />COOPERATIVE IMPROVEMENT AGREEMENT <br />Garden Way Preventative Maintenance <br />City of Eugene <br />THIS AGRE MENT is made and entered into by and between THE STATE OF <br />OREGON, a ing by and through its Department of Transportation, hereinafter referred <br />to as "ODO ;and THE CITY OF EUGENE, acting by and through its designated <br />officials, here Wafter referred to as "City". <br />', RECITALS <br />1. OR 99W, I also known as Pacific Highway West, is a part of the state highway <br />system under the jurisdiction and control of the Oregon Transportation Commission. <br />Garden V1ray, Coburg Road and Country Club Road are a part of the city street <br />system unifier the jurisdiction and control of City. <br />', 2. By the au hority granted in ORS 190.110, 366.572 and 366.576, ODOT may enter <br />into coope ative agreements with the counties, cities, and units of local governments <br />for the p rformance of work on certain types of improvement projects with the <br />allocation f costs on terms and conditions mutually agreeable to the contracting <br />parties. <br />!,NOW THERE~ORE, the premises being in general as stated in the foregoing recitals, it <br />!,~is agreed by alnd between the parties hereto as follows: <br />,TERMS OF A~REEMENT: <br />',1. For the pu~pose of providing acceptable traffic patterns on City and ODOT roadways <br />during the onstruction of ODOT's I-105 Willamette River -Pacific Highway project, <br />hereinafter referred to as "Roadway Project", ODOT and City agree to improve <br />Garden W y, on which the City currently is conducting a roadway improvement <br />project, an use this portion of roadway for the routing of contractor truck traffic <br />', during the construction of the Roadway Project, hereinafter referred to as <br />"Contracto .Detour Route", as shown in Exhibit A attached hereto and by this <br />', reference ade a part hereof. The improvements to the Contractor Detour Route <br />', include rei forced PCC driveways and added asphalt concrete depth to Garden <br />'' Way. <br />~. ODOT sha I use the funds available for the Roadway Project to contribute to the <br />'~ Contractor ~etour Route under this Agreement.
