2.4 Within thirty (30) days after its receipt of the Contractor's submission for <br /> '"approval of a significant change, City shall notify Contractor of its approval (or disapproval) of <br /> such submission and of all revisions made in the Proposal as a result thereof. Revisions <br /> made pursuant to this Section 2 become a part of the Proposal. <br /> 2.5 As a result of approved revisions made under this Section 2, Contractor's fee <br /> shall be equitably adjusted for any increase or decrease in Contractor's cost of, or time <br /> required for, performance of any services under this Agreement. In all cases, Contractor will <br /> rebeive fair payment for work completed to date. Any claim of Contractor for adjustment <br /> under this paragraph must be asserted in writing within fourteen (14) days after the date of <br /> City`s approval of the revision. <br /> 3. , Time for Completion. <br /> 3.1 Contractor shall commence the Work anytime after May 15, 2001. <br /> 3.2 Contractor shall deliver the Work to City from May 15, 2001 through December <br /> 31,', 2006. Sculptural elements of the Work shall be completed in accordance with City's <br /> construction schedule. Failure to deliver as specified shall constitute a breach of Agreement. <br /> 12.2.a Contractor may deliver Work to the City prior to December 31, 2006 with <br /> approval from the City. Work will be stored until time of installation at <br /> City expense. <br /> 3.3 City will grant reasonable extensions of time to Contractor only if there is a <br /> lay on the part of City in performing its obligation under this Agreement. <br /> 3.4 Contractor will notify City when sculptural elements of the Work are ready for <br /> shipment to the project site. <br /> 3.5 Contractor will make every effort to ship the completed Work via a shipper who <br /> inures the Work for the full cost, including but not limited to, materials, artist time to produce <br /> arld time to remake in the event of an accident in which the Work is damaged and deemed <br /> unusable by City. <br /> 4. Consideration. <br /> The consideration, which City shall pay to Contractor for the Work in this Agreement, <br /> as described in Section 1, shall be thirty-two thousand dollars ($32,000.00) as follows: a <br /> design and non-exclusive right to build design fee in the amount of twelve thousand dollars <br /> ($12,000.00), a construction fee for four sculptures in accordance with design drawings of <br /> <br /> sixteen thousand dollars ($16,000.00), and a coordination fee in the amount of four thousand <br /> <br /> dollars ($4,000.00), payable as, follows: <br /> 4.1 Phase 1: The first payment of twelve thousand dollars ($12,000.00) will be <br /> made upon receipt of an invoice from Contractor for the bridge design fee. <br /> 4.2 Phase 2: The second payment of four thousand dollars ($4,000.00) will be <br /> made upon receipt of an invoice from Contractor for the coordination fee in connection with <br /> ^~ing, fabrication, and construction of the bridge. <br /> 4.3 Phase 3: The third payment of sixteen thousand dollars ($16,000.00) will be <br /> Personal Services Contract - 3 <br /> <br />
