HEREAS, ORS 190.010 provides that units of local gandract vi ies tthat a parrytto the W or all function agreements for the performance of any agreement, its officers ar agents, have the authority to perform; and WHEREAS, CITY need for grant writing services in support of the Delta Ponds Barrier Removal Project; and WHEREAS, LCOG has personnel capable of performing these services for CITY; and WHEREAS, the scope of work is as described in Attachment A and the cost to CITY for these services shall not exceed $4,000. NOW, THEREFORE, it is agreed that: 1. LCOG shall provide grant writing services to CITY as outlined in Attachment A. 2. The agreement term shall be December 8, 2005 through January 31, 2006. 3. CITY shall pay LCOG upon receipt of an invoice. The invoice will be based upon actual hourly costs for LCOG personnel plus any direct costs associated with the work performed. The total cost of this agreement shall not exceed $4,000. 4. Each party working under this contract is either a subject employer under the Oregon Worker's Compensation Law and shall comply with ORS 656.017, which requires each to provide Worker's Compensation coverage for all its subject workers, or is an employer that is exempt under ORS 656.126. 5. This contract may be modified or extended by written amendment signed by both parties. 6.
