City of <br /> Eugene / City of Springfield / State of Oregon Page 2 0~ <br /> Agreement No. 19131 <br /> 03-03-13 zoned R-1 w/PD overlay and AG/UL Tax Lot 1001 on Assessor's Map 18-03-03-4 <br /> zoned RAlUL, and a portion of Tax Lot 700 zoned AG/UL inside the UGB with access to <br /> Laurel Hill Valley; and the Larson/Furtick (and Merrill) Commercial property, identified as <br /> Tax Lots 400, 800, 900, 1000, 1100, 1200, 1500, 1600, 1700, 1800, 1900 on Assessor's Map <br /> 18-03-03-23 and zoned C-2 w/SR overlay; and Tax Lot 1100 on Assessor's Map 18-03-03-20 <br /> and zoned C-2 w/SR overlay and aze herein ~ in after referred to as Surrounding <br /> Developments. These developments are identified in Exhibit B attached hereto and by this <br /> reference made a part hereof. These developments, referred to as Son Blaze Village and <br /> Surrounding Developments, are anticipated to be developed in conformance with the adopted <br /> Metropolitan Area Plan and will likely be built in phases. Improvements to the transportation <br /> system, required to mitigate the impacts of the development, have been identified in the Draft <br /> Traffic Impact Analysis for Son Blaze Village and Other Surrounding Developments, dated <br /> April 9, 2001, and amendments dated June 5, 2001, prepazed by JRH Transportation <br /> Engineering and submitted to the City of Eugene. This Agreement establishes the <br /> responsibilities of the parties to provide those improvements. <br /> 5. Pursuant to ORS 374.305, ODOT has the authority to regulate any construction or use on <br /> state highway right of way, including regulating any approaches of public and private roads to <br /> a state highway. Glenwood Boulevard, a city street with a right of access to I-5, operates as <br /> an approach road to I-5. Glenwood Boulevazd, (Brackenfern) is proposed as the major <br /> collector providing access to the Glenwood Interchange/Son Blaze Village and <br /> developments. It is proposed to connect to Glenwood Boulevazd at the intersection of Moon <br /> Mountain Dr./Glenwood Dr. and the Brackenfern Extension as shown on page 7 of Exhibit <br /> A, Drawing 2. <br /> NOW THEREFORE, the premises being in general as stated in the foregoing RECITALS, it is <br /> agreed by and between the parties hereto as follows: <br /> TERMS OF AGREEMENT <br /> 1. In consideration for receipt of a public approach road permit from ODOT for the <br /> connection of Brackenfern, the City of Eugene shall ensure that certain transportation <br /> improvements are constructed prior to issuing building permits for the proposed Son <br /> Blaze Village and Surrounding Developments. ODOT has determined that the public <br /> approach can be mitigated consistent with the safety of the traveling public pursuant to <br /> the criteria in OAR 734-051-0080(2) and the function of I-5, based upon the Agreements <br /> and covenants set forth herein. <br /> <br /> 2. Improvements aze to be made to the Interstate 5 Judkins Point interchange, Glenwood <br /> Boulevard, Glenwood Drive, Moon Mountain Drive, 25a' Avenue, and the Brackenfern <br /> Extension of Glenwood Boulevard, hereinafter referred to as "Project". The details of the <br /> proposed developments and the Project are shown in Exhibit "A", attached hereto and by <br /> <br />
