Contracts & Agreements <br /> i~r~ Agreement No. 19131 <br /> COOPERATIVE IMPROVEMENT AGREEMENT <br /> THIS AGREEMENT is made and entered into by and between THE STATE OF OREGON, <br /> acting by and through its Department of Transportation, hereinafter referred to as "ODOT"; and <br /> THE CITY OF EUGENE, a municipal corporation of the State of Oregon, acting by and through <br /> its City Officials, hereinafter referred to as "City of Eugene"; and THE CITY OF <br /> SPRINGFIELD, a municipal corporation of the state of Oregon, acting by and through its City <br /> Officials, hereinafter referred to as "City of Springfield". <br /> RECITALS <br /> 1. Interstate S, also known as Pacific Highway and I-5, Glenwood Boulevard in the area of the I- <br /> S Judkins Point Interchange, (also known as Glenwood Interchange) and Glenwood Drive <br /> within the boundaries of the Project described herein, are parts of the State highway system <br /> under the jurisdiction and control of the Oregon Transportation Commission. Moon <br /> Mountain Drive, East 25a' Avenue, and the proposed Brackenfern Extension of Glenwood <br /> Boulevard aze each parts of the Eugene City Street System under the jurisdiction and control <br /> of the City of Eugene. The portion of Glenwood Boulevard northeast of I-5 is part of the <br /> Springfield City Street System under the jurisdiction and control of the City of Springfield. <br /> 2. By the authority granted in ORS 190.110, 366.770 and 366.775, ODOT may enter into <br /> cooperative agreements with cities for the performance of work on certain types of <br /> improvement projects with the allocation of costs on terms and conditions mutually agreeable <br /> to the contracting parties. <br /> 3. By the authority granted in ORS 810.210, ODOT is authorized to determine the character or <br /> type of traffic control devices to be used and to place or erect them upon State highways at <br /> places where ODOT deems necessary for the safe and expeditious control of traffic. No <br /> traffic control devices shall be erected, maintained, or operated upon any State highway by <br /> any authority other than the ODOT, except with its written approval. <br /> 4. Private residential and commercial developments are proposed and anticipated to be built <br /> neaz the Glenwood Interchange in the City of Eugene. The proposed developments are <br /> identified as Son Blaze Phase 1, identified as portions of Tax Lots 104, 200, and 300 on <br /> Assessor's Map 18-03-03-00 zoned for a Planned Unit Development; Son Blaze Phase 2, <br /> identified as portions of Tax Lots 104, 300, and all of Tax Lot 105 on Assessor's Map 18- <br /> 03-03-00, zoned for a Planfied Unit Development; Son Blaze Commercial Development, <br /> identified as a portion of Tax Lot 204 on Assessor's Map 18-03-03-00, and zoned C-2 <br /> General Commercial with Site Review. Collectively, these proposed developments are <br /> referred to as Son Blaze Village. Anticipated developments include the Smejkal and <br /> McDougal Residential property identified as Tax Lots 109 and 1000, on Assessor's Map 18- <br /> <br />
