3.2. Final payment due within 30 days after successful completion of the contract and City's <br /> approval of the plants. <br /> 3.3. Except as otherwise set forth herein, requests for any additional payments under this contract <br /> shall be made to the City in writing and shall be made before the additional expense is <br /> incurred or additional work is undertaken. <br /> 4. Equipment. Except as set forth in Exhibit B, Contractor shall provide all materials, equipment, <br /> supplies or other items required for performance of the Services. <br /> 5. Contract Administration. Each party designates the following as its representative for purposes <br /> of notice pursuant to paragraph 23, and for purposes of administering this contract: <br /> Contractor: Sheila M. Klest <br /> Trillium Gardens <br /> P.O. Box 803 <br /> Pleasant Hill, OR 97455 <br /> City: Brian Elliott <br /> City of Eugene -Parks and Open Spaces Division <br /> 1820 Roosevelt Blvd. <br /> Eugene OR 97402 <br /> Either party may change its designated representative by giving written notice to the other as <br /> provided in paragraph 23. <br /> 6. Performance of Services. Contractor shall perform the Services with a high degree of profession- <br /> alism consistent with industry standards, and shall at all times during the term of this contract <br /> strictly comply with the following requirements: <br /> 6.1 Supervision. Contractor shall designate afull-time qualified supervisor of Contractor's <br /> performance of the Services, who shall have full authority to act for and on behalf of <br /> Contractor. The supervisor shall be available during regular business hours. At all times <br /> during the supervisor's absence, a designated subordinate shall be in charge and available at <br /> the location of performance of the Services. <br /> 6.2 Personnel. Contractor acknowledges the high degree of importance City places on the <br /> behavior, appearance and service performed by Contractor and its personnel. Contractor's <br /> personnel shall at all times be neat, clean and courteous, and Contractor shall not permit its <br /> employees or agents to conduct themselves in a loud, noisy, boisterous, offensive or <br /> objectionable manner. Upon objection from City concerning the conduct, demeanor or ap- <br /> pearance of any of Contractor's employees or agents, Contractor shall forthwith take all steps <br /> necessary to remove the cause of the objection. Upon the employee's or agent's failure to <br /> immediately and properly correct his or her conduct, Contractor shall promptly cause his or <br /> her job assignment under this contract to be terminated. <br /> <br /> Non-Facility Trade Service Contract--Page 2 <br /> (Revised December 1997) <br /> <br />
