If the City will be hiring a contractor or contractors to perform any work involving the <br /> Project (including initial construction and any subsequent relocation or maintenance and <br /> repair work), the City shall require its contractor(s) to: <br /> f • execute the Railroad's then current Contractor's Right of Entry Agreement, <br /> ~ • obtain the insurance coverage described in Exhibit B-1 hereto attached, and <br /> • provide the insurance policies, certificates, binders and/or endorsements to Railroad that <br /> are required in Exhibit B-1 before allowing any of its contractor(s) and their respective <br /> t subcontractors to commence any work in the Crossing Area or on any other Railroad <br /> property. <br /> B. The City acknowledges receipt of a copy of Railroad's current Contractor's Right of Entry <br /> Agreement, attached hereto as Exhibit E and hereby made a part hereof, and confines that it <br /> will inform its contractor(s)that it/they and their subcontractors are required to execute such <br /> form of agreement before commencing any work on any Railroad property. Under no <br /> circumstances will City's contractor(s) or any subcontractors be allowed on to Railroad's <br /> property without first executing the Railroad's Contractor's Right of Entry Agreement and <br /> <br /> ~ obtaining the insurance set forth therein and also providing to Railroad the insurance <br /> policies, binders, certificates and/or endorsements described therein. <br /> C. All insurance correspondence, binders, policies, certificates and/or endorsements shall be <br /> sent to: <br /> Union Paciftc Railroad Company <br /> 1400 Douglas Street MS1690 <br /> Omaha, NE 68179-1690 <br /> ATTN.• Senior Manager Contracts <br /> UPRR Folder No. 1575-11 <br /> D. If the City's own employees will be performing any of the Project work, the City may self- <br /> insure all or a portion of the insurance coverage subject to Railroad's prior review and <br /> approval. <br /> ARTICLE 6 - FEDERAL AID POLICY GUIDE <br /> If the City will be receiving any federal funding for the Proj ect, the current Hiles, regulations <br /> and provisions of the Federal Aid Policy Guide as contained in 23 CFR 140, Subpart I and 23 CFR <br /> 646, Subparts A and B are incorporated into this Agreement by reference. <br /> ARTICLE 7 - WORK TO BE PERFORMED BY RAILROAD <br /> A. The work to be performed by the Raihba~d, at the City's sole cost and expense, is described in <br /> the Railroad's Material and Force Account Estimates: <br /> • Signal Estimate dazed September 30, 2007, in the amount of $24,436.00, marked Exhibit <br /> C, <br /> • Track & Surface Estimate dated Apri130, 2007, in the amount of $63,156.00, marked <br /> Public Highway Crossing w!
