Notwithstanding the subsequent Highway Grant described in Article 3 below, the Railroad <br /> hereby grants to City the right to commence Project work Within the Crossing Area with the <br /> express understanding, however, that no work shall begin by any of the City's contractors <br /> within the Crossing Area or any other properly of the Railroad until: <br /> • The Railroad and City have executed this Agreement, <br /> • Each contractor has executed and delivered to Railroad the Railroad's standard <br /> Contractor's Right of Entry Agreement in the form marked Exhibit E, attached hereto <br /> and hereby made a part hereof. <br /> • The Railroad has received from each contractor the insurance policies, binders, <br /> certificatesand/or endorsements set forth in Exhibit C of the Contractor's Right of Entry <br /> Agreement. <br /> • The Railroad's Assistant Vice-President Engineering-Design or his authorized <br /> representative has provided written approval to the City of the final one hundred percent <br /> (100%) completed plans. <br /> B, The City also agrees to perform and abide by all of the terms of this Agreement, including <br /> Exhibit B and Exhibit B-1, attached hereto and hereby made a part hereof. <br /> ARTICLE 3 - GRANT OF HIGHWAY GRANT <br /> Upon completion of the execution of this Agreement and Railroad's receipt from City of <br /> FOURTY-TWO THOUSAND DOLLARS ($42,000.00), the Railroad shall execute and deliver to <br /> the City a Highway Grant in the form marked Exhibit D, attached hereto and hereby made a part <br /> hereof, for the property described on Exhibit A-l . <br /> ARTICLE 4 - VEGETATION CONTROL <br /> The City is also granted herein the right of entry to control and remove from the Railroad's <br /> right of way on each side of the Crossing Area, the weeds and vegetation which may obstruct the <br /> October io, 2007 <br /> Public Highway Crossing w/Highway Grent Articles of Agreement <br /> Form Approves.
