i
y
Public Works
Engineering

err City of Eugene
244 East Broadway
Eugene, Oregon 97401
(541) 682-5560
(541) 682-8410 FAX
Memorandum
Date: December 27, 2006
To: Jeff Perry, Finance
From: Jenifer Willer, PW Engineering (x5364)
Subject: Mill Race Headgate Rehabilitation (GJN 4315)
Contract 2007-00013 Triad Mechanical, Inc.
This memo is to address exceeding contract change order limitations. Engineering is the process of
approving a change order for this project which will result in a 29.14% increase from the original contract
amount and wishes to obtain your approval as well. This is the only change order for this contract as the
work is complete and we intend to make final payment in the next pay estimate.
Background
Due to age and deterioration the headgate structure of the Mill Race located at approximately 10"' and
Ferry Street, Engineering worked with Parks and Open Space to design the rehabilitation of the structure
and its fixtures. The City publicly advertised this project and received three bids as follows:
Triad Mechanical, Inc. $67,868
Brown Contracting $84,654
Triton Group $118,300
In working with Parks and Open Space staff, it was determined that the headgate and underground pipe
system lacked access for maintenance and cleaning, and it was decided to add a manhole to the 30"
diameter concrete pipe just beyond the headgate. I requested Triad to submit a proposal for the extra work
which they did on 10/20/06 for a lump sum cost of $24,433. I felt this was excessive and asked if Triad
would be amenable to performing the work on a time and materials basis which is allowed under sections
00196 and 00197 of our Standard Specifications for Construction if a price agreement cannot be made
prior to the work. As stated above, the installation of this manhole was a benefit to the City for
maintenance and access considerations. Additionally, this work benefited the contractor and the City in
assisting in performing dewatering activities for the primary contract work.
In addition to the manhole work, there were several unanticipated items of work that arose that were
addressed by the change order and resulted in a net increase to the contract.
Additional Work
As stated above, Triad originally proposed to install the manhole for $24,433. Triad agreed to the City's
1
i ~ ~ _ ...,r.~. M,.~~~~~R-fr~~
