CITY OF EUGENE FEDERALLY FUNDED PUBLIC IMPROVEMENT CONTRACT EUGENE AIRPORT 2006 TAXIWAY REHABILITATION ECHO AND ALPHA 5 BETWEEN: The City of Eugene, an Oregon municipal corporation ("City") AND: Wildish Construction Co. ("Contractor") CONTRACT NO.: 2006 - 28 JOB NO.: 4371 Contractor's CCB No. 695 RECITALS A. On March 9, 2006, City issued an invitation to bid (the "ITB") for construction of certain improvements at the Eugene Airport. B. Contractor submitted a bid, which included a price and all certifications and representations required under the ITB (the "Bid"), in response to City's ITB. C. On June 2, 2006, City determined that Contractor was the successful bidder for construction of the improvements described in the ITB and this Contract. AGREEMENT SECTION 1. THE CONTRACT. The contract between the parties ("Contract") includes this "City of Eugene Federally Funded Public Improvement Contract" ("Base Contract"), all of the documents in the Project Manual ,the Project Plans and Specifications ("Plans"), all properly executed change orders and amendments to the foregoing, the ITB and the Bid, both attached hereto as Exhibit B, incorporated by reference, the Performance Bond and Payment Bond securing Contractor's obligations hereunder, all insurance certificates and endorsements described herein and delivered by Contractor in connection with the execution of this Base Contract and all Exhibits to this Base Contract. 1.1 Exhibits.
