THIS AGRE~MENT is entered into by and between LANE COUNTY, a political <br />subdivision of the State of Oregon, hereinafter referred to as "COUNTY", and the CITY OF <br />EUGENE, a municipal corporation, hereinafter referred to as "CITY": <br />RECITALS <br />1. ORS 190.010 ~nd the Lane County Home Rule Charter pravide that units of local <br />governments may enter into agreements for the performance of any or all functions and <br />activities that a party to the agreements, its officers or agents, have autharity to perForm; and <br />2. ORS 373.260(1)(a) provides that counties and cities may enter into <br />intergovernmental agreements for the construction, improvement or repair of right-of-way for <br />any county road or city street within the corporate limits of the city; and <br />3. The COUNTY is performing engineering and construction management services for <br />the Prairie View Affordable Housing Project, a 76-unit apartment development for low-income <br />households on Unthank Road, and incorporating said services into one project that includes <br />the CITY portion of Unthank -Road adjacent to a future park in order to provide for best <br />efficiencies; and ~ <br />4. The road improvement project will construct Unthank Road adjacent to the <br />undeveloped park (estimafed length of 310 feet) in the summer af 2007, and will hereinafter <br />be referred to as PROJECT. <br />AGREEMENTS <br />COUNTY AGREES TO: <br />1. Provide primary surveying, drafting, and design engineering services as ,required; <br />Prepare plans, specifications, and contract documents; Determine permitting requirements, <br />provide drawings and other technical design engineering support and prepare applications if <br />needed on behalf of CITY for environmental or construction permits. <br />2. Perform all construction management duties related ta PROJECT according to the <br />plans and specifications developed for PROJECT. COUNTY shall be the sale contract for <br />the successful bidder for all contract issues and the PROJECT contact documents will be bid <br />using COUNTY contract administration documents. COUNTY shall call for bids, award and <br />administer the construction contract for PROJECT. <br />0? ~Q~~ 1 ~ <br />
